I have ask this seller over 5 times to send a return labe, they said take item to the post office, they are waiting for item, there is not shipping address from the seller, they are game playing, why won't they send the return label,someone rechecked the camera and it truly is defective, I just would like to simply receive a refund

Have you filed a "not as described" complaint?  If not, do so.......the seller will have to provide a return label thru ebay with in few days.......If they don't, you will receive a full refund.........

Did you actually open an ITEM NOT AS DESCRIBED CASE with eBay? 

If you had done that, then you needed to wait 3 days for a response from the seller.

No response and no label?  Then you would return to that case and request that eBay step in.

eBay would have refunded you from the seller's funds and told you to keep the item.

You had 30 days after receipt to open that case with eBay.

Seems like the seller is counting on the fact that you appear to not understand how the Money Back Guarantee works.

Quit messaging the seller.  If you've not opened the case, do so NOW.

If you have, and it's been over 3 days, return to that case and ask eBay to step in.

Then, PLEASE take the time to read the MBG.  There is no need for back-and-forth with a seller.

Chances are that you bought from a dropshipper or overseas seller. Those sellers at times select "label already sent" within the return case interface on their end when they actually have not provided you a return label. 

 

If seller does not send a return label within 3 days and the "Ask eBay To Step In" option is not available, you will have to contact eBay thru the help menus.

 

Or just contact eBay thru Facebook. https://www.facebook.com/eBayForBusiness/
Using the instant messaging. Explain that the seller has not provided a return label.

Under NO circumstances do you close the return before getting your refund, REGARDLESS of what the seller might tell you.

If it's the seller I think it is, they did something that sellers from that country are notorious for doing - they string you along until your 30-day MBG period runs out. And that's what this seller did. You're past 30 days and since you never opened an official return request for NAD, you are SOL. 

 

If it's the $7.49 item, you might consider just taking the loss and checking the seller's feedback BEFORE future purchases. Also, compare the seller's location to where the listing shows the item as being located. (In this case, seller is in China but item location is claimed to be Deer Park, New York so seller is dropshipping.)

 

If you don't want to take the loss, you can file a chargeback dispute through your payment method. If the seller doesn't refund, he'll also get hit with a $20 chargeback fee.
