Return Request Not Going Smoothly...

Several weeks ago we sold a point and shoot camera. Got paid and shipped it out. Upon receipt the buyer contacted us telling us that it had hairline scratches on the view screen that he could only see when the camera was NOT being used. Despite our No Return policy he claimed that since these scratches were not specified in the listing the item was SNAD. He sent through a return request.

 

We accepted the return request and sent the return shipping label. Now we receive a message from the buyer telling us that he actually lives in Canada (although his "confirmed shipping address" was a UPS store in New York) and he now wants us to send him additional funds ($30) to cover the cost of return shipping it from Canada  "Or with that amount I can just use it to sell it as is for $20."

 

Our position is that we did not ship this item to Canada and all of our listings are restricted to sales to the US ONLY. We are, therefore, in no way prepared to send this buyer ANY money; not for return shipping from any address other than his confirmed one and certainly not for him to profit by re-selling it (the original sale was $29.95 for the camera with $10 shipping).

 

According to the Return Details eBay says "We've asked the buyer to ship the item back by Nov 14...If the buyer doesn't send the item back by Nov 14 we may close this return." It is now the 15th and it has obviously not been return shipped.

 

Is it worth trying to contact eBay Customer Service or at what stage will they see that it has not been returned by yesterday and "close this return?"

Heck YA call eBay!   You have already provided a label and you are under absolutely no obligation to send this buyer a penny.   Once an item is forwarded the buyer loses MBG protection. 

 

Call ebay, explain the situation and request the return be closed. 

 

Your buyer could still open a dispute on Paypal but they would be on the hook for return shipping and even that I might try to get closed although unlikely.

Its not your problem, You sent a return label. I would go silent and say nothing. After 5 days of no return tracking activity, call eBay and have them close the case in your favor. SAY NOTHING MORE to the buyer and BLOCK. I would NOT call eBay, if I did, it would be in attemp to show there is no eBay MBG because the item was forwarded.

OP has already stated that the buyer is beyond the window of returning the item.   

 

They should call ebay and have the return closed immediately.   The fact the buyer is also in Canada and not entitled to this return in the first place doesn't even matter at this point. 

 

They missed the deadline.

This morning we contacted eBay customer service and just received the following message from them:

 

We reviewed this case and have closed it without any refund to the buyer.

The case will not affect your seller performance. Any feedback left for this transaction will be removed.

The buyer did not return the item to you within the required timeframe.

 

Now the question is, will eBay do anything about someone like this; Buyer is BASED in Canada but has a "confirmed shipping address" of a UPS Store in upstate New York? Obviously to circumvent someone like us with a shipping policy of US Only... Not unlike the item I received, yesterday; after specifying US Sellers Only I receive the item with a shipping label with a Chinese customs declaration listing the item as a "Commercial Sample" sent to the Kentucky address from where it was forwarded to me...

The buyer didn't break any rules so there is nothing for eBay to do.   There is absolutely nothing that prohibits buyers outside of the US from purchasing and having their item shipped to a US address.  They do void their MBG protection though once it is forwarded beyond there. 

 

As far as a your item from China, if the seller in that case misrepresented item location, that is a violation of policy.

once you've sent a return label to the buyer it's their problem to return the item.  If they do not the case will be closed in your favor by ebay after the specified time.  If it doesn't close automatically after the specified time, call ebay and they will do it.  this will not be a defect for you.  If buyer open a case in paypal all you need to show paypal is that the item was delivered per tracking.  Paypal only cares if the item did not get delivered per tracking.  BLOCK THIS BUYER in your personal ban list for sure though.
