Refund on fakes?

I believe I was sold a fake or refurbished Samsung Galaxy s22 Ultra. I ordered it brand new, chose the color, and the seller had a 99% positive rating. So it looked veryuch legit. I did as much research on them as possible.

 

The phone was insanely expensive plus I lost another 5k on customs duty. Can someone suggest what you think is the best way to get back as much of my losses as possible? 🙏Thank you people

What makes you think it's not new?    If it were returned, you would have to try to get customs to refund the duty. Some will on a returned item. Don't know if your country will. How long ago did you purchase it?

When a buyer receives an item that's not as described, the buyer can open an item not as described case within 30 days with eBay.

Why do you think it was fake or used? Did you contact Samsung to verify @adman3000?

I think I'm still in the 30 days comfort zone. I'll make a decision today as I'm going to see an official Samsung store to see if they can tell me what's really going on. Thanks!

There's a lot of clues. It may or may not be fake, or counterfeit, but for sure it's NOT new. They described the item as: "100% an authentic and new one" So:

1. In the phone settings I saw that this phone has been previously operated or owned by someone called "Azi". 2. There are several important Samsung stickers on the box and on the back of the phone, that were missing.

3. The phone performs very sluggishly and not like what I have experienced on new s22 Ultra phones which are very quick. 

4. To make sure, I'm not paranoid, I went to the official Samsung store, who ran the phone through their software and told me this phone is definitely not new, and has been used before and re-packaged.  

5. And I'm not the only one. 190 other people have also had the same story

 

I have asked the seller to refund me the full amount of (including the tax) and I will return it to them. But they are now stalling, so I've asked E bay to intervene ( I received it on April 7)

I am now waiting 8th day with no movement on s22 ultra from seller I don't know if we are allowed to mention seller names but I am now seeing people's reviews. Some say all was good and new sealed but others say they are repackaged from same store refurbished and all. Ive waited all this time with usps not having the scan of the item so I can't even track it. The seller is kind and informing it will soon get scanned by usps on next center it arrives at. Turns out the seller In New Jersey is shipping from China. I never order from Chinese stores. This was a cover up or something. The store has 99 positive also. I wonder why people aren't mentioning the store names ??? This is why I haven't yet. I am upset and thinking about telling the store in message on ebay to refund me now as I will be checking imei and running software diagnostic that Samsung engineering mode shows everything I need to know if used or not oem parts etc. Not sure this will scare them but I guess otherwise I have to keep my money held hostage until this gets to me if and when. My anxiety is had. I am being **bleep**.

You have responded to a post that's over two yrs old.  Let's hope that OP has handled their issue by now.

eBay offers a very good money back guarantee to buyers.  The catch is that the buyer has to read it, understand it and use it in a timely fashion.

On the order when you made the purchase, you saw an ESTIMATED DELIVERY DATE.  Evidently, that date was OK with you, or you wouldn't have bought it, right?  Once your package is over due by at least one day PER THAT DATE, you have 30 days to open an item not received case with eBay.

May I humbly suggest that you take just a moment to read that MBG? There is no necessity to go through all those maneuvers or to contact anyone.  Overdue? Open the case.

The problem or problems I have are fear due to the reviews on same item same listing type by same seller the reviews are more detailed and more stating they were not new and sealed but refurbished or etc. No way to get Samsung to honor the warranty or etc. My worries are non oem parts and battery life. The listing date changed 2 times since purchase. I ordered on the 8th. The store is set listed as US seller in new jersey. But since apparently shipping has been slow usps still hasn't scanned my package. Monday will be the latest original shipping date ... from 14 til 18th latest I think. But again that changed to 18th to 22nd. No. Of course I had no issues or I wouldn't have ordered. The issue is there's been no movement and although they are kind and responding I am now anxious and being told rest assured usps will soon scan the packaged as they reached out to them. I pulled it up on global shipping with tracking number since USPS doesn't see it. That showes it's been on a plane in china 2 times and last update from 15th says from where the Jamaica NY is back on another airline but shipping app aftership shows no movement and a check with carrier if any questions due to no activity and the package on that app shows the dot in Jamaica NY the entire time. So it's very overwhelming. Since all this has been showing some china stuff I looked at more of the seller reviews in which a few have received sealed devices but are showing IMEI has been used and or non oem parts. So my nerves are ultra shot .... I just know we don't live in a fair world sadly. But at this point I'm waiting anxiously to what will likely look like a refund in the making. So I am concerned hence my post. I've bought and sold on ebay years and never fell for the Chinese store marked as US store so I'm a bit upset. My own fault of course. I appreciate your feedback regardless.

If you’re pulling the listing up in any way other than looking at it through your purchase history, you’re seeing what the shipping date would be if it was purchased NOW, not what the date actually was when you purchased it.
