Purchased a iPhone that was advertised as "New". Once received I contacted Apple who informed me that the phone was originally purchased 6 months ago. I then call AT&T to check on the IMEI and was told the phone was reported lost or stolen. I contacted the seller who issued a return immediately. He received the phone unopened (still in its shrink wrap) 16 days ago. His refund check bounced and now ebay is not backing up their "Money Back Guarantee" telling me the seller issued a refund. I submitted my Paypal information to ebay which states the refund did not go thru due to seller's bank did not approve the check. I will be filling a law suit either against the seller or ebay, if i do not get a refund within the next week.

I'm a little confused about your experience ... so, let me explore a couple of paths.
Did you open a Money Back Guarantee case on eBay ... or simply contact the seller and ask them to fulfill a "Money Back Guarantee"?
If you did not open a Money Back Guarantee case on eBay, then do that ... and put in the tracking number for the return.
You received a check?
Assuming you opened a case already, getting a check sounds like a refund approach from 15 years ago. Perhaps you mean an e-Check ... let me go with that.
If so, I believe this is a PayPal issue, and not an eBay issue.
From what you wrote, I assume you paid originally through PayPal. If so, your refund is supposed to be back through the original payment method. Regardless, if the payment fails to go through, you work with PayPal to get the payment properly transferred to you. Call them and ask for advice.

Finally got confirmation from EBay and PayPal of the refund. It shouldn’t take 20 days after the product was returned to get a refund. I do appreciate EBay standing by their guarantee.
