Question regarding item stuck in transit

I purchased on item last month that had an estimated delivery date of 3/15. The item has not had a tracking update since 3/11. I opened an item not received request asking for a refund because the 30 day time limit is approaching. The seller response that it is out of their hands and they cannot do anything until I receive the item and send it back to them. They sent me tracking info, which I already had, so they really didn't help me. I understand that they have no control over the item being stuck in transit, but it doesn't look like I am going to receive it anytime soon, if at all. I want to be fair, but I am concerned about the time limit I have to get this handled. Advice?

Perhaps the seller isn’t aware of how things work but if you opened an item not received claim and the seller can’t provide proof of delivery, they will have  to refund you.  If they don’t refund on their own you will see an option to ask ebay to step in after about 3 business days. Ebsy will then refund you and bill the seller. 

I really wonder how a seller expects you to send back an item that you never received.

you buyer protection 30 day limit starts on the estimated or actual delivery date, not from the purchase or ship date, so you still had 9 days. the seller clearly doesn't know eBay's policies because it is his problem to fix if you don't get your item. just have eBay step in and help on the request and they will give you your money back and bill the seller for the refund amount. Don't worry, most sellers on eBay are responsible and take care of their customers and for the times you run across a bad seller, eBay has your back.

@skipp_kathy You have purchased an item on a platform that offers a money back guarantee so you have nothing to worry about. Seller is either new or a stubborn fool who thinks things work the way they want only. You've already opened the item not received so just follow the timeline and it will close in your behalf. If you don't hear anything just contact eBay and have them step in. Everything is handled via your INR case. Stay positive that you'll be fine and stop messaging this seller. That will only lead to more misunderstandings. Best of luck to you....

Did you ever get your money back? 
I was just wondering because I'm in a similar situation except in my case the shipping company (FedEx) is saying that they won't deliver it to me because it was damaged so its stuck in "transit" pending for the past 5 days and I'm worried I wont' be able to get my money back since the seller's only response was that its in transit.  
I just filed an item not received through eBay so I have to wait 3 days before I can ask eBay to step in...hopefully when they step in they don't say that its in transit and I need to just keep waiting....indefinitely

eBay may put an extension on the non-receipt claim to allow additional time since there are recent tracking scans, but when the extension expires you will be refunded if the package hasn't been delivered yet @omarh2 .
