I ordered a new item on eBay. The seller provided a UPS tracking number. Two days later I received the very same item that I had ordered but it came from Amazon via Amazon Prime. The package from Amazon only had my name and address with no information about who sent it. There was a note inside indicating it was a gift but no indication of who it was from. I thought it might be the item I had ordered but the UPS tracking number indicated the item was still in transit. Two days later the UPS tracking number indicated that UPS delivered the package to my address that very afternoon. However, there was no package delivered. I inquired with UPS about this and they said they had delivered a package and that I should check with my neighbors as sometimes a package will be left with a neighbor. This was not the case. UPS then suggested that I contact the seller about the issue. The seller also suggested that I check with my neighbors. I then asked the seller about the Amazon delivery. The seller has not returned any communication since.
My guess is that the seller took my order and then ordered the part from Amazon which was $10 cheaper than his price on eBay. But his price included shipping. So I have to conclude that this seller has a Amazon Prime account and orders much of what he sells from Amazon. Since Prime members don't pay for shipping, if he orders enough from Amazon, and includes the cost of shipping in his price, that eventually cover the cost of Prime and the rest is profit. I really have no problem with this except that when I inquired about this with UPS and the seller, no one would confirm the situation. What I don't understand is that how could UPS issue a tracking number then not deliver anything but indicate delivery then just blow off an inquiry.
Has anyone else run into something like this?

You're taking the hard route with all of this. I'm all for contacting the seller first, but the seller stopped communicating with you. The item isn't the same. Open a not as described return request. When a prepaid label is issued, return it. Easy and done.

That tends to earn a neutral from me. I hate getting my items from tere and it tells me I didn't buy from a seller, but from someone who doesn't believe in honesty.

The item you received from Amazon is stated as a gift. You were willing to concede that maybe it is the item you ordered on eBay and you gave the seller the opportunity to tell you if they sent to you. The seller has not communicated with you to confirm or deny they had Amazon send your item.
You have absolutely no proof that item from Amazon is the item you ordered. The seller has not confirmed this and have instead provided you with a UPS Tracking Number for your item.
You can not claim the Item "Not as Described" because you have not received the Item the seller sent to you based on their UPS Tracking provided to you.
Forget about the Amazon package, that was delivered as a gift from someone. Did you ever call Amazon to find out who sent you the Gift? The Gift from Amazon is a different issue and you have now stated that it is not the same quality of what you ordered from eBay.
Forget about the Amazon Package. I would not even mention this again. If there is some relationship with the two shipments the Seller needs to explain this to you and so far they have chose not to.
You need to concentrate on the missing UPS package that eBay shows being sent and delivered to you.
Since it was delivered to a different address it is only speculation why that happened. I do not know how you can prove to eBay that you did not receive the UPS package, but that is where your claim is.

Since the Amazon package is similar to what was ordered, the OP should concrete on that.
OP found several other items from the same seller, using Amazon pics, so the chances are the seller drop ships from Amazon.
The seller used the old "same zip code scam" with a UPS package. The UPS package is a red herring and should be ignored.
The OP should file NAD here on ebay, and send the Amazon item back to the seller.

That was actually I that said that. I think your missing my point. A gift from a unknow person was received from Amazon. The buyer asked the seller to confirm if they are the one who sent the item thru Amazon and the seller has not confirmed. What the seller did do is include on the Shipping Details a UPS Tracking number for the item they sent. This is two different packages and the seller is not confirming the Amazon Package is from them. Why would the Gift from Amazon be required to be returned? Its a gift, it was not ordered by the buyer.
I did suggest the buyer call Amazon and find out who the gift is from.

No, return it to the eBay seller, who dropshipped it.
Even drawing a supposition from their other listings, it is just as valid to say the seller did not droppship this incorrect item. And hurling insults does not substitute for evidence either way.
In particular,
- in a NAD on the UPS tracking number,
- it would be fraud to return a random item .

I filed a non delivery claim with both UPS and the seller.
It took some doing but UPS ultimately told me the actual address of their delivery. It was to a street address on the other side of town. I won't pursue the package delivered since it is obviously not the item I ordered as the weight of the package is significantly less than that of the item I ordered.
As for the eBay seller, without providing any insight regarding this situation or even responding to any of my requests for information, he just gave me a full refund of the purchase price.
I will not attempt to return the "gift" to the seller since no one will confirm that it actually came from the seller. Amazon will not divulge the name of the person who sent the gift other than to tell me it's a registered LLC. According to the Amazon website I can return the gift but only for a gift card. I tried contacting Amazon customer service (which is a feat in itself) and was able to get a CS rep on the telephone. Not having any idea how to proceed, the CS rep transferred me to someone else. After a lengthy period of time on hold, I ultimately implemented the Kevorkian Disconnect. I will try again with Amazon. I know I have no legal obligation to return this item.

This just happened to me!! Said it shipped via UPS, but it’s Amazon from a seller in Turkey per the shipped from. Should have been NJ. I denied the Amazon calls and cancelled via EBay. What a joke. I hate Amazon!!
