Multiple Items Missing From Order

As a buyer,  I order 10 items in a lot purchase from the seller. The box these items were shipped in fell apart in transit and only 3 of the purchased items were delivered. The seller has asked me to contact USPS to follow up, which I have with an answer of "we have looked at our centers and didn't see any sweaters". I escalated to Ebay that I did not receive the items ordered and they denied my claim stating that the package was delivered to my address. I should not be having to pay 100% for something I only received 30% of. Does anyone have thoughts of how I should escalate this further? I have currently just applied to return for a refund. It should be covered by the Money Back Guarantee, but they denied it so fast the first time that I am at a loss. The seller packaged it poorly, the post office destroyed it, and somehow I am the one left holding the bag (and one with a hole in it at that). This is my first real issue with Ebay and so far I feel out in the cold with no help.

Any suggestions are appreciated.

If it was shipped via a method that is insured by USPS you can file a claim with the USPS either online or at the post office. You will need to take the package to the post office to show how it was originally packaged along with the record from the eBay sale showing the value and what you paid for the items. The seller also has  the ability to file a USPS claim but it is generally easier if the buyer does so since they are in possession of the received package. It is difficult to get the USPS to pay out for damaged shipments but I have managed to get reimbursed for damaged shipments. 

     Yours is one of the few cases where I have heard of eBay backing up the seller but from what you have stated above it appears you filed claiming item(s) not received which in fact they were but the shipment was incomplete.

Was there a single price for all 10 items in the lot, did your return request use the reason Missing parts or pieces, and if so, what does eBay show as the estimated refund since you do have 3 items?

 

After 3 business days, if your seller has not offered an acceptable partial refund THROUGH THE RETURN REQUEST for the missing items, or has not Accepted the return and issued a return label, click Ask eBay to step in to step up to the next step as you step through these steps, step by step, to get your refund.

You filed an item not received, and you lost, because you DID receive something, just not everything.

 

File a not as described complaint in the resolution center, citing missing parts/pieces. Your seller should issue a prepaid return label. When you return the remaining items, you'll be refunded in full.
