I recently ordered a item that was scanned delivered even though the mailman was no where near my building at the time of delivery (I was right outside the building waiting ironically when I got the text saying delivered) . I contacted the seller who advised me to wait another day which I did but was also prudent enough to open a case. Now my post office contacted me and claimed the package was scanned delivered at my building which is impossible however if that was their story I figured I was SOL on getting a refund. Day after this call the seller messages me saying he went to his post office and they claimed the item was scanned delivered at the wrong address and sent me the info as to where he believed it was and to call them. I did, they claimed they didn’t receive any package. At which point I informed the seller that wherever this was is claiming they don’t have it. However since it was misdelivered I am entitled to a refund and since he has a claim he has to file with USPS. He told me he would file but that these claims get denied most of the time. Am I under any obligation to wait for him to file a claim? If so if his claim is denied am I not entitled to a refund? I already started the process as I feel this seller is just trying to make this my problem and before his message I would’ve believed that to be the case. However he himself is acknowledging misdelivery so shouldn’t that make being reimbursed now his problem?

'scanned delivery at the wrong address'...meaning seller put wrong address on package writing it on package?
Was it an eBay shipping label?
'scanned delivery at the wrong address'...would a seller see that in tracking?...I haven't seen that.
Sounds fishy...

If you started a refund request at eBay
-- you will lose
-- it will close without a refund
-- and you won't be able to leave feedback.
That's because an Item Not Received case is decided solely on tracking showing delivered. And if you try the same, an Item Not Received case at PayPal and later with your card issuer, you will also lose without a refund.
More advice is coming.

You need to go to your PO and ask about the package.
See if the package was addressed to you or someone else.
If it was misdelivered, they can go back and try to get the package.

The package was addressed to me the address however it was delivered to wasn’t my address and this admission came from the seller

According to the seller it was delivered to the wrong address via the geocode the manager of the local post office told him. He claims he put the right address and I believe him as mailmen are well…stupid. However if it was misdelivered by his own admission. Nevermind mine, shouldn’t that require him to refund me?

I really am not expecting miracles here but was just wondering as the seller even though he is telling me this info is so resigned to him not being able to cash in on the insurance he put on the package and not being able to refund me. If the info shows it was misdelivered I don’t know why that would be the case and it feels as if he is trying to leave me holding the bag here for something that is neither of our fault but happened

the best course of action here (always) is to reach out to the carrier in person, they have the GPS hand scanner and can verify when and where it was scanned, if they made a mistake they "may" be able retrieve it, really depends on the exact circumstances.
not the post office, THE CARRIER the mailman/mail lady whichever the case may be.
you want to do this ASAP when it happens while it is still fresh in the carriers mind.
and unless the shipping status is changed online, you are out of luck otherwise.

Yeah I figure as much which is kind of messed up, I have different mailmen here all the time so no way to even know who the mailman was. Oh well I figure I’m going to try thru eBay and if they deny me, then I guess I’m out $100 and needless to say won’t buy from the seller again as well I personally feel he has no intention of refunding me my money even if he gets his claim approved

The quickest way for you to find your package is to talk to the carrier. If you live in a building, does it have a mailroom? Have you checked with neighbors?
I do find it odd the seller told you it was delivered to another building. Is this building nearby?
If you go back to the USPS, see if they can tell you the weight/size of the package. If that does not match up with what you ordered, there may be more going on here. Be careful not to accuse your seller of wrongdoing, but be prudent and act fast.

What you need to do is have your PO confirm whether the item was addressed to you or not and ideally get it in writing. This will determine if your seller is being legit or not, most would just ghost you so this one might be on the level. If it was addressed to you and miss-delivered then there's no reason they can't refund you and collect the insurance, slam dunk win if the PO admits their mistake.
If however the item was not addressed to you, the seller is not being legit and recourse will be a bit more complicated. Return here for further advice if this turns out to be the case.
Understand, this is a weird situation from the sellers perspective since all we see is the 'delivered' scan. If the seller is legit they could think you're trying to scam them.

Thank you everyone, seller is now trying to **bleep** as he doesn’t have documentation to support what he told me and can only go by the scan now lol. However joke is on him as I opened another claim with the post office and got confirmation in writing that this item wasn’t misdelivered on their part but was in fact mislabeled on the sellers. No wonder why he was so quick to try to tell me the claim would get rejected because he goofed up and knows he goofed up. Now let’s see if he’s determined to go down kicking and screaming on this

First you say the seller admitted the package had the wrong address.
Then the seller claims he put the right address.
Which?

No way to figure out who the mailman was?
Shouldn't your local PO know that information?

I had a question about a package one time, I think it had to do with the address. anyway, I went to the post office with the tracking number, and they pulled up a picture of the package that clearly showed the address. From what I understand, every package has a picture taken of it.
