Est delievery date I received in my
email when I paid for item said dec 10th but seller has not marked my item as shipped and has not responded to any messages about me asking if they have or when will they ship.

First,
1. When did you purchase the item?
2. What is the sellers handling time?
3. How is it being shipped? (Priority, 1st Class, etc.)
4. Did you pay with an eCheck? (This will slow down the shipping as the seller has not received a cleared payment)
At this time of the year many sellers have more than a one day handling time, but still try to get items mailed within one day after receiving a cleared payment. Today is only the 4th and there is still 6 days before eBay's ESTIMATED delivery date.

Sellers do not have to respond to you
Sellers do not have to mark shipped
They should, but do not have to.
If your item does not arrive when it should you can open an INR in the resolution center

I am sorry your seller is non responsive. I know that can be alarming, especially at this time of year. What was your seller's handling time on the listing you purchased from? If they had 3 day handling or more, they are still within that timeframe. Handling time is based on Business days, not calendar days.
I hope you hear from them very soon and all is well. If not, then on the 11th [since the purchase said the 10th], open an INR claim. Your seller will respond or Ebay will just refund you.

If the estimated deliver date has passed, but the seller still has not shipped nor has responded, you can file a "I didn't receive it" report. Open your purchase history, find the item, click "More options", click the option and submit the information. eBay will forward this to the seller, and give him 3 business days to work out a solution.
