I sold/shipped an iphone last month to a person in the Ukraine. Two days ago they opened a case because they have not received it. I checked tracking and it left Jamaica, NY on Jan. 26th.
Long story short...I am now finding out that the item is restricted in the Ukraine and should have not been sent. So my question is...I have the GSP turned on - why did it not go through there? If that is a restricted country why did the sale go through period? And third...who has to take the hit on this?
I feel like there was some kind of glitch on eBay to let this sale go through internationally without going through the GSP since that is the only option I have on my account.
Anyone else have something like this happen?
Please note, I did purchase my shipping label through ebay and did not modify the receioients address. I was just going through the motions and until this case opened I didn't realize it didn't go through the GSP.

You take the hit on this. The GSP may have been disabled on the listing if Iphones are restricted & can't be imported into Ukraine. Ukraine is a GSP-eligible country. Its hard to say what happened without seeing the listing. Did the buyer send a request for an invoice? If they did & you sent an invoice then you unknowingly took the sale out of the GSP.

After some further research it doesn’t appear that iPhones are restricted in the Ukraine (the eBay rep I spoke to earlier told me they were).
I didn’t send an invoice to the buyer but looking back...I have the unpaid item assistant turned on and a case was opened for this item and the buyer paid a few days later. I wonder if somehow that allowed this to occur. I have escalated with eBay and they said I am covered but have to wait for everything to be reviewed.
This is such a weird situation and exactly why I have GSP exclusively for international shipping.

I think you should be prepared for eBay to force the refund and to also receive a defect for a "case closed without seller resolution".

It does not appear that you had GSP set up on the iPhone listing. I clicked on two other listings and they did not include GSP either. It looks like you are set up to ship direct for international sales.

I checked a few other listings and they are using GSP.
The iPhone listing did not have GSP.

I noticed that the shipping looked different when I reviewed it earlier. I spoke to two eBay reps earlier and they both stated the listing had GSP on it so I am not sure what the issue is.
All of my “shipping policies” have GSP exclusively so I am not sure how this happened.
Thanks for the insights- it is in eBay’s hands at this point.

No it’s still in your hands. The listing didn’t have the GSP on it.

No, it's not in eBay's hands, it's in yours.
The reps who said GSP was on the iPhone listing were incorrect. All you have to do is view the listing to see that.
It does not matter if this was an error on eBay's part or an error you made during the listing process. The bottom line is that you shipped direct so you're past the point of eBay doing anything to help. Having missed the settings in the listing, the time to question this was when you were creating a shipping label and saw that it was addressed to the Ukraine instead of Kentucky.
If the buyer files a claim you need to handle it. If you don't proactively accept responsibility before eBay steps in then you will get a defect on top of losing the item and money. This was an unfortunate and expensive way to learn a lesson.

I looked at the listing again. It looks like GSP was set up for some countries, but not for others. Here is a sampling:
Ukraine = no GSP
UK = GSP
Canada = GSP
Poland = GSP
New Zealand = GSP
Zamibia = no GSP
Vietnam = no GSP
Russian Federation = no GSP
Switzerland = GSP
Norway = GSP
Japan = GSP
China = no GSP
Chile = no GSP
The outcome is still the same... you shipped direct, you are responsible.
