Item sent to similar address as mine and tenant kept it for himself

I recently bought a $100 Tempurpedic pillow for my g/f's birthday & it was shipped usps with a tracking #.  Unfortunately, it never got to my address even though it said "delivered".  So I reported it on the usps website which was totally useless because it kept giving me error messages. I then told my postal carrier what happened & he said he'd look into it.  I mentioned to him that it might've ended up at an Apartment complex down the road with a very similar address.  Sure enough, I was right.  He said that there was a different carrier that day & they misread the address. Now they are trying to contact the guy who lives there but, so far, no dice.  The seller hasn't received it back either.  So i'm thinking that i'll likely never ever see that pillow.  And the postman made a good point when he said "If the guy took it out & used it, would you even want it back?"  Heck no!  I told him.

 

Anyway, I'm hoping that Ebay decides in my favor but i have to wait a couple more days to find out.  I'm wondering if anyone else, here, has ever had this happen to them.  Also, can ppl who keep your pkg's get in trouble or do they just get away scott free?

If usps misdelivered it and trackIng shows delivered to your address, eBay will not rule in your favor.  

 

What needs to happen is an claim needs to be opened with USPS. Did you contact your seller? Did you ask him to start a claim? If USPS has GPS showing it misdelivered they will pay the claim.

 

if you are trying to start a claim and it "errors out" you could call the 800 number and see if they can help you over he phone.

The money back guarantee doesn't protect against misdeliveries and stolen packages. The seller will win if they provide the tracking number. eBay sometimes issues a courtesy refund. But basically your issue is with the USPS and you should be dealing with them instead of going after the seller. If you have proof of the misdelivery via the USPS GPS info,  I would file a police report and see if an officer will go with you on an attempt to contact the residence who received your package.

DUDE..

 

Uh oh!   i think you may be out of luck.  Neither the Seller nor Ebay is  is  responsible for that misdelivery.  It is the PO that  goofed and  gave it to the wrong person  at the wrong address.   

 

I believe  you  will  have  to  try to  get  some sort of compensation  from  your  local Post Office.  Smiley Sad

Most of the carriers' scanners have a GPS capability that can pinpoint the actual location where the package was when it was scanned.  You'd have to go to your local PO and talk to the postmaster to get him or her to look up that specific information.  That MIGHT get you a break with your eBay (or PayPal) claim since it would refute the basic delivery scan.  eBay has been known to give "courtesy refunds" that don't come out of the seller's pocket.

 

Also, if the item was sent via Priority Mail, it was automatically insured for either $50 or $100 (depending on whether the seller is an ebay Top Rated Seller).  Since your Post Office has already admitted  that the item was misdelivered, you should have  success with an insurance claim.

As @missjen831 & @garmentvarmint2004 said, you should file a Complaint w/the PO.  There are specific rules when a person receives an item that they did not order - and what happened with your shipment falls within their barrier.  Either USPS or the alleged "thief" should reimburse you for the amount. 

 

I say this because I looked it up after seeing it so many times that "oh well, you got yourself a "free" item, and you do not have to return it, which is not so.  I will at times get items for a store up the street from me - same number/street only one is in Passaic and the other is Clifton.  I just call them and let them know it is here, or I bring it to them.  If the carrier was a new or filling in for your regular delivery person, maybe he used GPS had to deal with that too with a Sherrif Officer - scared the you know what out of me 😉  And your carrier should be aware of the exception too.  File a Complaint via USPS and let them deal with.

The rule about receiving stuff you did not order refers to packages addressed to YOU at your address.  If somebody sends YOU a gift, it's yours to keep, no charge.  A company can't just send unordered merchandise to you and then demand payment.  Opening mail NOT ADDRESSED to YOU at your address or any other address is a FELONY.  If USPS mis-delivered a package to an address NOT on the label, USPS needs to retrieve it, with police assistance if necessary. ~~C~~
