Item not received, been in us custom limbo for a month.

I have an item coming from china, item entered Miami ISC on jan 17,  it has been a month and nothing, no out of custom, no letter, no info at all, contacted seller to ask about any info he says china post just says it was given to USPS. I dont know what to do, it is $80, and seller apparently did all correct, but also, it seems items get stuck for lack of correct info on paperwork.... should i open a case? I mean is $80 you just dont give $80 to someone on a selling platform to get nothing...any advise?

Thanks for your reply, i waited until the final delivery date stipulated by ebay, and i opened a request to notify seller of delay, then out of nothing, then anfet 3 days with no other activity on usps system, the item already was in our zipcode hub and was delivered that same day..... weird but happy, i closed the case and gave good feedback already, customs info was ok it sems it was just a misplaced package.

As I'm sure you know, if you have not received any item you buy on eBay by the estimated delivery date (or the latest date, if there's a date range), you have 30 days to file an "Item Not Received" claim through eBay's Resolution Center*. There is a link at the bottom of virtually every eBay page. 

 

If it has been more than 30 days since the latest estimated delivery date, you may file the same kind of case in the PayPal resolution center within 180 days of that date.

If it is beyond 180 days, you could try your credit card company, if you used a credit card to pay for the transaction. Credit card issuers have varying lengths of time within which you can file for an item you haven't received. (My card issuer allows only 60 days from the date of the statement on which the transaction appears, for example. Some offer shorter time frames, some offer longer.)

 

*Please note in the actual purchase was more that 60 days ago, you'll have to file with PayPal. eBay cannot facilitate a refund if the purchase was more than 60 days ago. Some eBay transactions have an estimated delivery date beyond that 60-day limit--especially purchases from overseas sellers.
