beware, lesson learned
trying to resolve an issue, the shipper stated they would send a replacement which would take 30-40 days, still never received and now theres no way to resolve this issue through ebay? i followed the steps of talking to the company and they offered a solution which i agreed, but i am still not receiving the item as they stated and no way to contact ebay now. future do not agree with shipper, be sure to open case or ebay will not help even though its documented in your messages

Nope, no way to resolve this through ebay since they give you 30 days after the actual delivery date to open a case. However, if you paid via PayPal, they give you 180 days after the transaction date, although they also require you to pay for return shipping.

When you didn't receive the item you purchased despite several attempts, open an "item not received" dispute:
http://paypal.com/disputes
Then go back and immediately click Escalate to PayPal.
Ignore if your seller contacts you now, do not close the case, and just wait for your refund.
