Item destroyed on arrival, why can't I file a claim?

First off, I bought an item (3 box DVD set) from somone with 1 Positive Feedback. Risky and my fault.

 

The item was shipped "Media Mail". It arrived today and the cases were smashed to pieces. I have no way of telling if this was USPS or the sender. It was wrapped loosely in a padded envelope which means it could have moved around.

 

However, the DVDs all have scratches and a gross film on them. It looks like someone licked them and tried to clean them with their sleeve. They have streaks and dirt. Something that a "Like New" item should not have. Something USPS could not do.

 

However, the buyer included a "return item". This is the only option I see to click on. I do not want to return this garbage and have him say I damaged this myself. It truly looks like somone took a hammer to the cases and the DVDs are useless. Plus, I have to pay shipping.

 

What are my options? Can I fight the return by sending in photos of the gross film all over the CDs? They won't even read. Thanks.

File a SNAD complaint with eBay.

Please read up on eBay's Money Back Guarantee. If the item isn't as described, the seller must pay for the return shipping label. You most likely will need to return it to get the refund.

 

Go to your purchase history on your My eBay page and click on More actions. Then click on Return this  item; then select Doesn't match description or photos.
