I think seller lied about refund-options?

I purchased an item that arrived not as described. In his listing, the seller requested to be contacted if there were any problems before opening a dispute so I sent him an email and explained the issue. He apologized and said he totally missed the problem and offered either a full refund, including shipping both ways, or a half refund on the whole purchase. I thought this was very generous and decided to accept the partial refund and keep the item because it was close to Christmas and I didn't have time to get to the post office.

 

Last week I looked on my PayPal account and discovered he didn't send a refund. I sent him another email and he quickly responded and said he forgot the refund because of the holidays and said that he just refunded my account. I trusted what he said and even left a positive rating over the weekend. I didn't even think to check for the refund until today. It is not there. Could there be a delay with the refund or has he been lying to me? I'm just outside of the 30 day window for opening a dispute on eBay. Do I have any other recourse? I looked on PayPal, but it said to go to the eBay resolution center.

How did you fund the payment? If he refunded through the PP transaction, the refund goes back to the source. So debit, credit card, giftcard payments go back to the card. You can file with with paypal, they encourage you to file with ebay but you can just go to the paypal resolution center and open a case. Since you are outside the money back guarantee, the seller can simply close your return request and that would be the end of it as far as ebay is concerned but you can then file with paypal.

I paid via PayPal and the funds were taken from my credit card. If he refunded me, wouldn't that transaction show up on the PayPal account even if the credit eventually was posted back to my credit card?

Yes, there should be a seperate PayPal transaction visible in your account for the refund.  Additionally, the original PayPal transaction will now read "Refunded - Payment" as opposed to simply "Payment".  It may take several days for the refund to actually show as pending on your credit card - I had a PayPal partial refund on Friday that still has not hit my card.

Thanks for all the advice. Nothing at all was on my Paypal account summary and I never receieved a notification of the return.  I emailed the seller again because it did not make sense that he would be trying to deceive me. He had a flawless record, many transactions, and has been very polite and responsive. It turned out that he sent it to the wrong email. It is not a valid email, so I hope he will be able to get his refund returned easily.
