So here is my problem, basically I bought a note 9, the seller sent the note 9 to my address but got rejected because of my lack of communication, tried to reach out to the seller to pay a re shipment dont have a problem doing that, but I did not get an answer from him in the whole month, tried to make a case with ebay saying that I dont want a refund that i would like to get the phone, they closed the case and told me the following:
"The seller provided tracking information that shows the shipping carrier tried to deliver the item to your address. You can pick it up from the shipping carrier.
Final decision:
A refund won't be issued for this case."

Your seller is not going to ship it to you again @gerald199.9 and actually had the option to refund you just the item price less original shipping. But since the seller has done neither, and eBay didn't force a refund either, you need to get your money back and move on to make another purchase.
If you paid with PayPal, open an Item Not Received dispute http://paypal.com/disputes then go back immediately and click Escalate to PayPal. Unlike eBay, PayPal will see that the delivered zip code (back to the seller) is not your zip code (the reshipper) and will force a refund within 11 days. Do not close the case if your seller contacts you now, for example promising to ship again (they won't).
Otherwise, if you paid with a credit card, call the number on the back to file a chargeback for the reason Goods Returned, Credit Not Received and provide your card issuer the tracking number. You'll get a provisional refund the same or the next day.
