How to resolve a issue?

How am  I suppose to resolve a issue with a item I purchased that is brand new but doesn't work when the seller is unavailable for the next 4 to 5 days?

You have 30 days from delivery to open a case for Item Not As Described in the Resolution Center & 180 days from date of payment to do the same with PayPal.

 

So I guess a few days to wait for the seller to surface should be bearable.

Actually, for the best outcome, you don't wait.  You open a Not As Described case in the Resolution Center, you wait until the date that ebay says they will "step in", and as soon as that option becomes available, you ask them to step in.  If the seller has not responded before then, ebay will give you a refund.  If the seller has responded and has sent you a return label, you send the item back.  If he has given you a refund without asking you to send it back, then you can do as you please with the item.
