Ebay sided with a seller who never responded to me on how to send back an item and found because it wasn't returned in time, I won't get a refund. I then accepted I had been played by the seller not responding. I then opened the item and it was broken. There seems to be no way of going through ebays procedures to send it back as when I attempt to do so it states ebay has closed the case. But, you still have a right to a refund if am item brakes within one year. So, ebays procedures are illegal. There policy does not super exceed uk law. It has been over 180 days so cannot get paypal involved. I have contacted the seller five times but still no responce. Any advice would be helpful.

you shoud have used the MBG and asked ebay to step in when you had the chance
if you opened a retunr you were supposed to send it back..you should have received a return label
I would try paypal or the UK board

Because it wasn't returned in time you won't get a refund? That's correct. There are timelines.
DIid you buy from a US seller? Once you open a return case you have 5 days to put it in the mail. If you're returning an item you no longer want you pay return shipping.
If the reason for the return is it's not as described the seller has to furnish a return label or be responsible for return shipping costs. If they do nothing you must ask eBay for help. If eBay isn't asked for help then the case will automatically close 21 days after it's opened with no refund.
Then you must go to PayPal and file a dispute there. You have 180 days on PayPal.
Sounds like you waited too long at both places.
You said you have a right to a refund if it breaks within a year. That is incorrect. eBay does not have a 1 year return policy. You have 30 days to return an item on eBay.
