How Can I Resolve This ?

Early Jan. of this year, I purchased a watch ($160) from what seemed like a reputable seller (LuxyVIP), based off of hundreds of reviews. I used my debit card via PayPal to pay for this item. Tracking info was updated on order upon shipping and a few days later, I received a notification while I was at work that item was delivered. Item was no where to be found when I got home (I live alone). Contacted neighbors and checked everywhere, nothing. $160 item, I expected there to be a signature required or something. I contacted the seller to notify them that I had not received my package and to be sure that they had the correct address. He/she kept sending a generic response with tracking details and stating that item was delivered. I explained that I did not receive my product and if they could inquire with shipping services as to what time the item was delivered and etc. Seller stopped responding, I contact PayPal regarding the issue and they open up a case, same response (item delivered), contact Ebay and they opened a case, same response, I contact my bank (BoFA) and because the transaction was a debit card purchase, I was not backed by any protection. All of these cases took time to process, I contacted USPS twice to open a case but they stated that the person that shipped it, would have to open up a case because item may have been insured. Contacted the seller once again, no response. Contacted Ebay and NO help at all, they stated that they would not be able to contact seller, as case has been closed.

Any suggestions ?

That is a long time ago ... and beyond most appeals and protections.   I wish you would have posted when it first happened.

 

$160 item, I expected there to be a signature required or something.

Signature confirmation is for items $750 or more.

 

Any suggestions ?

I think it is important to embrace the possibilities here.  You can eliminate things like mis-addressed (because your seller likely used automated addressing based off your order, and they checked when you contacted them) and a scam (because your seller is reputable and a long-term seller).  That is, it is not your seller's issue, eBay's issue, or PayPal's issue.

 

This leaves two possibilities:

  1. A USPS Issue.  Your package was mis-delivered by the USPS ... you could have checked this with the USPS by having them check the GEO Location of the delivery, but I assume that they can't do this any longer.
  2. A crime issue.  Your package was stolen by a porch pirate ... you can file a police report to perhaps help them identify patterns ... sometimes home owners policies will cover theft off property.

I spoke with USPS about 2-3x and im sure you know how dreadfully long the wait times are via phone (I would have personally visited the office but I have a medical condition and very limited transportation). They never informed me that there may have been a way to double check geolocation of delivery and they stated that the person who shipped the item, would have to file the claim, as they are the one who paid for the shipping (which now im assuming I was misinformed) and all of this could have been avoided. Through the numerous attempts of messaging, claims, appeals, and awaiting responses and also being hospitalized recently, time has definitely not been on my side . I will make another attempt to reach out to seller and USPS to see it I can have the situation resolved.

Below is the first message I received from the seller regarding the issue, he never initiated a “mail theft” inquiry or followed back up at all.


“It has been my experience with other customers that a large majority of packages are found by taking the following steps below.

1. Ask neighbors if they may have received the package
2. Ask your local letter carrier where he may have delivered the package
3. Go to your local USPS as ask them where the package was delivered.
4. Ask other family members if the package was taken in by them.
5. If it was delivered to a mailbox, check the very back of your mailbox. Sometimes packages get pushed to the back and are missed.
6. If you sent it to someone other than yourself make sure they realize it is a package from you.

If the steps above does not help you to find your package, we will initiate a "Mail Theft" inquiry with USPS authorities on your behalf.
