Every time I try to report this seller it won't let me it stays on the item not received screen, after speaking with the United States Postal Service. It will not let me report them. The postal service is saying the seller is a scam and to report it to ebay.

Not having the item is not an issue that can happen. No tracking from the time it was shipped is not normal the post office told me to report them for scamming since they can't tell me anything.

You are covered by eBay's buyer protection policy, which they call the "Money back guarantee" but you have to follow the terms. What is the latest estimated delivery date? eBay won't accept a claim for "item not received" until the day after the last estimated delivery date, regardless of the purchase date or whether the seller has provided a tracking number. Then you have 30 days (after the latest estimated delivery date) to file the claim.
There's no need to contact the Post Offices, especially since they can't help you if you don't have a tracking number.

Just got off the line with them I did not know you have to wait after the estimated delivery date in order to get past the item not received screen I am not able to pass.

Why do you think its a scam if its not past the delivery date?

Here's more than you'll ever need to know about how it works. Good luck! >> eBay Money Back Guarantee policy

It is not normal to have a tracking number and not activity at all when you signed up for tracking updates. The post office told me to report the seller as a scam.

Thanks allready meet the requirements. I will get my money back either way it goes. My bank will make sure of it when I give them a notarized affidavit.

Ah, I didn't understand that you had a tracking number.
Don't expect the Post Office to know how eBay policies work. eBay policy says you should just report this specific item as not received. Let eBay decide whether the seller is a scammer. The lack of tracking updates might be because the seller hasn't shipped yet, BUT it also might be the fault of USPS, for failing to scan the package -- that happens once in a while. Either way, you have protection if there is not a delivery scan.

You don't need to go to the bank. Read about the MBG. Also it is not mandatory for a seller to give you the tracking number. The post office is lazy too sometimes and do Not scan packages rightaway. Something that is parcel post/select can sit in a warehouse w/o activity for a week or more. That does not mean that the item is lost or that the seller is a scammer.
