The buyer returned a empty package with nothing in it. Called Ebay they advised to post a picture to the return then they escaled it to Ebay. Once that was done Ebay returned the money to the buyer since there was a tracking number. The buyer now has the product and I am OUT $212.00. I have called Ebay 9 times and all 9 times they kept the same outcome. Do you have anyother ideas as to how I can get my money back?

I've heard that a copy of a police report can be used to appeal an fraudulent refund case.
Your going to have to fight hard to get your money back on this one.

If the please tell you it's a civil matter ask them if they will fill out a call for service, that explains the issue. All you need is something on official Police letterhead stating the issue.
Also if the city cops won't help, try the sheriff's department or the state police.

State Police are generally better equip to deal with internet fraud and theft.
Also to the topic: if you do use State make sure to file in their state also.

Problem with all the above suggestions is there is NO PROOF that the buyer did NOT send it correctly. An outside chance, but there are crooked delivery people, and typically an item goes through 3,4 or more places where there's lots of opportunity for theft.
So, first thing to look at: Who paid for the label...if you didn't- look at the weight on the return label.

Unfortunately, winning an appeal is just as hard as losing an NAD claim is easy. I'd prepare myself to be out the funds.
By offering Free Returns, you had the ability to reduce the refund by 50%, if you'd been proactive and just handled it.

If the buyer filed an Item Not As Described, the seller proceeds with the return label, correct? Thus the return label would/should be the exact same weight as the label that was used to send the item.
The label may not be accurate to reflect the weight of the package then, correct? If the buyer returns an empty package, that should have had a 2 pound item, for example, in it, that could not be proof as I see it.
BUT if the buyer went to the post office and purchased a label, the weight would be on the label to reflect the packaged item.
Correct me if I am wrong in my thinking.
This is always a horror to me, getting an empty package back.
