Help! Seller provided wrong tracking number, eBay denied Item Not Recieved claim

I hoping to get some clarity from others regarding my situation. I purchased a pretty expensive item ($2,000+) and recieved a tracking number from the seller about a week after the sale date. I assumed everything was kosher and followed the tracking progress like a hawk, due to the fact that I wanted to be present when it arrived and the item was a pretty penny. Fast forward this past Thursday, the item shows delivered and signed, however, the item is nowhere to be found. Bear in mind, I set my delivery address to my business, so someone is always present to sign and the USPS guy has a good relationship with us and always checks in. I do my rounds, asking everyone if they have it.... now dice. I ask around my neighboring businesses - cause, you know, it could have been dropped off at a different suite, no dice as well. So now I’m confused, and immediately request Proof of Delivery from USPS - the doc is emailed to me almost immediately. Unfortunately, to my dismay, the P of D shows the tracking # provided by the seller was for a different address and signed by someone the same day I was expecting my delivery. To make matters even stranger, the address was in the same city, literally 5 mins down the road from me. I look up the address and call, which happened to be a Dunkin Donuts. I explain my situation to the manager, who was the person that signed for the package, who assures me she recieved an envelope with the tracking # but it contained docs pertaining to their business. The item I purchased would only fit in a box, so I call USPS to see what’s going on. The agent is understanding and pulls up an image of the delivered package (in this case, the envelope) and explains that the tracking # I was provided by the seller was indeed the package delivered to this address, and the shipping label was not addressed to me. I contact the seller for an updated tracking #, but never receive a response, so I open up an Item Not Recieved claim which gets denied. I spoke to eBay to appeal and provide them a copy of the Proof of Delivery doc showing the tracking # for a different address, so now I wait for an answer. Just curious if this happened to anyone else, and what other actions can I take? From the get go, the seller has never responded from any of my messages, so I can’t get any clarity from their end. Help?

I provided them the Proof of Delivery doc from USPS showing the item was not addressed to me... it shows the EXACT address it was shipped to. USPS also had images of the package, which was an envelope - my item was a camera so c’mon. Isn’t it the Seller’s responsible to address the shipping label to MY address, plus, looking through this forum, this appears to be a pretty common scam that other people have experienced. Don’t know what to do from here...

if you have proof call ebay and ask to speak with a manager calmly explain what happened and they will have you email them the information next fill out a fraud complain with USPS it can be done on line if you  Try not to loose it when your own the phone it will get you know where if you paid with a credit card open a charge back but call the bank first and tell them what happend they may ask you to fill a police report Good Luck happened to you

@mikadobetacam09. Get the envelope from the donut shop and open a not as described case on ebay. You should still have that option.

How is returning the envelope from the donut shop (the one that the seller sent) mail  fraud?   How would you handle this situation if you were the buyer?

Fortunately, I called eBay this morning to dispute the denial. After a few transfer, I spoke with a Rep that understood the situation and will resubmit the appeal and follow up personally with me - apparently, whoever responded to my 2 previous appeals never looked at the USPS docs I submitted showing the fraudulent address and info. Now I wait for a response, was told it’ll take a couple days. Fingers crossed this get resolved, I’ll keep everyone posted.

Was the final CS rep from Trust & Safety?  If this person can't help you, that's where I would go next.  ebay needs to start hiring people with common sense, and enable them to make decisions.  Good luck!

Please explain how that would be mail fraud when that is what the seller sent to the buyer.  It would be a not as described case and OP can then send it back if the seller wants it back, and the seller will pay the return shipping.

An attempt to collect money not rightfully yours using the US Mail is mail fraud.  The OP has had their claim denied.  So returning an empty envelope in order to receive a refund would be considered mail fraud or at least warrant a report of it to the US Postal Inspectors and subsequent investigation.

 

Frankly, I've yet to see how the OP has determined that the seller provided the wrong tracking number.  Has it been determined that whatever was sent to the donut shop was what the should have been sent to the OP?  Was the item miss delivered?

It wasnt an empty envelope because it contained papers. And even if it was empty the buyer did not purchase air. That makes it a not as described. Its the buyers package. They have a right to receive it and return it. I still dont see how that is mail fraud.
