Having to prove to Ebay that fake make up is fake and dont want to return it

Hiya

I recently bought three make up palettes which were suppose to be authentic Kat Von D, one of the palettes was real , however the other two are not. The fake ones are dull in colour, have no shimmer to them and are powdery with slightly smaller pots whereas the authentic make up is shimmery, vivid colours and buttery texture.

I refuse to send them back as they are fake but i have been told i have to prove they are not real by getting in touch with the manafacturers or go to a make up store and get a headed letter from them to say the items are not fake, seems so ridiculous to me. The only thing i have sent are some shots of a video tutorial of Kat Von D herself using the make up palettes and you can see the shimmer in them and photos of the fake palettes i have . They have said they are waiting to get proof from the seller that the items are genuine now which i think is fair, I am hoping that I will still get my refund without having to send these back as I dont want others to be misled by the seller and want them off Ebay, any advice people please?

you should have just filed a not as described,forget about fake products,its not up to you to say if they are fake or not.Just pick a better reason like its broken.I know it sounds stupid but you should not be made to jump thru any hoops.All not as described are approved automatically for the buyers,not sure why ebay says otherwise in your case

eBay's policy is that counterfeit items may not have to be sent back if there is substantial evidence they are counterfeit thus they are asking you to provide the evidence required.  If you cannot provide that you will need to return them to the seller for a refund.

1tuna is right just file a case and get your money back without having to go thru hoops
Let the seller have their fake (if it is) item back . if it is fake you don't want it anyway right. Simple'

Unless you can prove they are fake or send them back ebay nor paypal will refund. Ebay is right about proving they are fake. I had to send in proof that I item I had brought years ago on ebay was fake. This is one area ebay will not take just the buyer's word.

Any time I see a buyer claiming something is fake and refusing to return it, I always wonder why they'd want to keep something fake

Although you may correct that they are fake, if you want your money back you need to return the product. You can leave appropriate feedback.

My advise is to either get the proof that they are fake or return them, if you want your money back. If you want to keep them, you aren't going to get a refund.
