Handling time of over 31 days, USA seller.

Hello,

 I recently placed an order for some carbide turning tool bits. I was in a hurry and just added them to my cart and checked out.  Immediately after checkout I saw the estimated delivery was over a month out. I went back to the listing and much to my dismay I saw that the seller has a handling time of OVER 31 DAYS! This seller is in Pennsylvania, USA. I immediately requested to cancel the order, but no response from the seller,  after 5 days and Ebay said I can no longer cancel. I messaged the seller requesting to cancel but no response.

 Why does Ebay allow this, when it is in clear violation of the FTC rule, that states all mail, internet and phone orders must be shipped within 30 days of payment?

 And yes, I know I should have looked a little closer before placing the order, but over 31 days is just  rediculous and should not be allowed.

Kind of hard to answer without seeing the listing.  Since you already bought, you should be able to post the listing number.

Does the seller ID or just the item location state Pennsylvania?

 

Many of the scammy Chinese sellers state a US location for the item. Then if you check the actual ID, you will see the seller registered in China.

You are mistaken. Sellers cannot set a handling time of over 30 days. I believe you have misunderstood the information on the listing and the delivery date is 31 days away. That’s allowed here and you should have read the listing before you bought the item because the delivery date was there. The seller has to ship the item within 30 days under the FTC rule.

I suspect that he is drop shipping from China.  I personally dont buy from China (limiting my searches to North America) because of the fraud and long shipping time.  Too many sellers drop ship these days then try to just shrug when you receive the WRONG item or no item at all. Good call trying to cancel.  I would just file an item not received (INR) dispute after a week.  He will have a hard time showing shipping from overseas.

The estimated delivery date is 31 days, the INR can’t or shouldn’t be filed until then.

@rixstuff The estimated delivery date is 31 days away. The OP is either mistaken here or doesn’t know the difference between delivery time and handling time. The OP cannot file an INR with eBay in a week. There is nothing to suggest drop shipping from China. You can’t just assume the seller is drop shipping from China. He may be selling pre-orders. Or listing items before he has them on hand.

I  completely agree with you on this matter!  ebay should not allow this as an option to sellers to have the ability to take 31 days for shipping inside the US,  how is this seller getting away with this?  And how is this not dragging down the sellers dashboard scores?

Previous FB for the same item indicates quick shipping.  Maybe the seller is on vacation right now and extended their handing and shipping times.

It says the combination is over 31 days:

 

"Estimated between Sat. Mar. 31 and Thu. Apr. 5

This item has an extended handling time and a delivery estimate greater than 31 business days. "

Oh please. The estimated delivery date is posted on every listing, buyers should take responsibility and hit the back button if the delivery estimate is too long.

If that's the case, the seller should cancel the sale, and suspend the listing. Going on vacation is not a valid reason for breaking FTC rules.
