Hello, I have a buyer who won a bet but it took around 10 days to make the payment, when he received the item, he said it was defective, the item was brand new and sealed, he broke the seal, what can I do to not refund the money?

Not much. Respond to the case, send him a return label, and when the item gets back to you, you'll probably have to issue a refund. Be sure to respond to the case within the time frame allotted by eBay. When you get it back, you may have options depending on its condition.
As for the buyer breaking the seal, kind of hard to use an item if you don't open the package.

I am assuming he opened a Money Back Guarantee claim. If so, you have two choices:
By the way, a customer cannot judge if an item works or doesn't work if it is still sealed in the package ... it has to be opened to determine that. Keep in mind that brand new items do not always work out of the box.

Nothing.
The question is, do you want the item back before refunding?
If buyer has filed an INAD, accept the return and pay return shipping.
If you don't, Ebay could refund buyer from your Pay Pal account and let them keep the item.
