Once a seller - when eBay would not help me in getting paid from a buyer, I lost that money.
Now as a buyer - they're refusing me a refund after the seller posted an item that did not fit as advertised!! I was told "We don't have to adhere to any US laws, we're an international company". swear to God - that's what he just told me.
Quite obviously, from reading all of the comments and problems on the discussion board - it's time to hold eBay liable for their scams.

Did you file an "item not as described" case against the seller? If so, how long ago? Was it within the 30 days of the last date of the ETA?

The statement above is complete nonsense. If you bought the item on eBay, you are protected by eBay's MBG - as long as you follow the rules to get your money back. I have not had a problem getting my money back in cases where the item was not as described.

If you want to return clothes that don't fit you need to buy from sellers that accept returns and stay away from China or Asia purchases because the return cost with tracking is $50.30.
If you ordered a 10 and the label said 10 it's as described. eBay says doesn't like how it fits or looks after getting it is buyer's remorse, and if the seller accepts returns you can return it. If not you're stuck with it. You can't go by size charts because you don't know if the garment is measured lying flat or if they stretch the garment out to it's max length/width.

If you used the does not fit reason for the return, if you are waiting for a return label you are out of luck. As a remorse return, the return shipping is on your dime. As a seller you should have known that.

It was an auto part - for the model and year of my specific car. It is falsely advertised.

This is not "buyers remorse" as you're so ready to point out - it's a car part that does not fit my vehicle afterall. The seller misadvertised a part.

Shame on your for jumping to this conclusion - I am not an ignorant person, nor am I unintelligent. I bought a part for my vehicle - it is not as advertised.

If you selected doesn't fit when you opened the return, Ebay does consider it a remorse return.
You should have selected the item doesn't match the description.
If seller accepts returns, you will have to pay return shipping.
If seller doesn't take returns, there's not much more you can do on Ebay.
You can open an INAD on Pay Pal but you'll have to pay return shipping.

Does not fit AS ADVERTISED - is not buyers remorse. Every CSR I've spoken to has agreed with me - then finally, last week one agent asked me to wait 5 more days for a return label - in doing so, she basically pushed me off to another agent....your defense of the indefensible is horrifying to me. Shame on you.

Sorry - but you're mistaken. The two reasons for allowing a buyer a refund include the Seller posting a product then sending you something that is not as advertised.
Stop responding to me - I can't imagine what eBay does for you to defend them in this.
