Hello all. This is my first Ebay related post. Recently, I sold a piece of sporting goods equipment to Ebay user and ebay user. He opened a dispute because the item hadn't arrived yet. On Feburary 2nd 2018, I gave him a refund for the amount with the expressed instructions that if it shows up to either return the item to me or to contact me if he wanted to purchase the item. A week passed and I checked the tracking. It arrived on Feburary 5th, but he did not contact me. When I contacted him, he claimed he did contact me and that paypal still hadn't refunded him, but he thought it was ok because the item arrived. Called paypal, called ebay....both claim otherwise. Still claims he didn't receive refund, claims it is issue with paypal. Took screen shot of refund and to which account. Still claims no money and refuses to return item. Reported him.
So after a bit of a rant, my question is this. What happens to him? He has stolen an item from me. What does Ebay do at this point?

eBay does nothing to him. They can’t force him to repay or return the item. If he filed an INR and you didn’t have proof of delivery by the 3rd business day you needed to call and get the case placed on hold. Basically eBay expects the buyer to receive their item no later than the latest delivery estimate on the listing and if they don’t, they get a refund. If the item is delivered shortly after they buyer gets a refund you can try to file an appeal with eBay and all that happens is eBay gives you a courtesy refund. Buyer keeps their money.

Do you mean the military firearms parts you're not even supposed to list?
Military ordnance such as weapons, ammunition, and their related parts—even if the items are considered demilitarized, demilled, rendered inert, or unserviceable. We can't confirm whether an item has been changed in such a way that makes it safe and legal to sell or transport

OP did that. Again, the buyer cannot be forced to pay, eBay cannot make them pay. And if the buyer didn’t file an INR, eBay won’t give the OP a courtesy refund.

Looking at the OPs items, I see nothing he has sold that is on the Not Allowed list.
You cannot list:
Firearm frames, including grip frames, muzzleloader and black powder frames or receivers
Firearm kits used to create a firearm
Firearm receivers, including upper or lower, incomplete, "cut" or "80%" receivers
Flash suppressors
Any magazine sold in violation of state or local law. High capacity magazines that accept more than 10 rounds are not allowed. Please note that some states may have a lower capacity limit.
High capacity magazines modified to accept 10 rounds or less are also prohibited unless permanently modified by the manufacturer.
Magazine extenders
Sears
Silencers
Grenade launchers
Bump fire stocks
Parts or accessories for assault weapons. Listings that mention capability with an assault weapon, even if the part or accessory fits non-assault weapons, are also prohibited.
The following parts for semiautomatic pistols: barrel shroud, forward pistol grip and threaded barrel
Pistol conversion kits that make a pistol into a short-barreled rifle
Bayonets designed to fit an assault weapon
Blueprints, milling or forging specifications for assault weapons
Instructions or blueprints on how to convert a semi-automatic weapon to a fully automatic weapon

The way I read it, the seller voluntarily refunded.

You gave him a refund in unsupported good faith. Ebay sees this as you simply gave him the money, and the item is in transit. There's no fraud here. Fraud would be if he clearly got the item, then tried to claim he didn't, then tried to file an INR. You can't, "give instructions" to a buyer to repay you because you were hasty. It would be nice if he paid you, but I don't see any reasons why he technically should because you were antsy.

I'm in California. I had this happen and never got paid back or item back from a party in Florida. I contacted the Sheriff there and explained what occured and he said he would be happy to help to contract him if needed. Fast forward over 1 year and I'm in Florida on vacation. Stop by the Sheriffs office and he sent a Deputy with me to the guys address. Should have seen the look on the scammers face when he opened to door and I told him who is was and why I was there with a Deputy. Got my $300 back on the spot, $200 cash and $100 check and the Deputy was kind enough to let the guy know if the check bounced he would be visiting him again in the very near future.
