I purchased multiple items from same seller. Long story short: they didnt send initial puchase but they sent the others (4 items paid, 3 of which were received, all vntg tees approx 140 shipped).
However they uploaded same tracking for all (paid individually, not multi ordered invoiced together).
Now ebay thinks I have their item as in generating me a label (for what? I dont have item purchased) to recieve my refund under their guarantee.
But I have nothing to ship! Never got the item. They just think I did because seller fraudulently manipulated tracking!

I'm sorry this happened to you but you really need to call eBay and speak to customer service. Explain to them what happened. Because eBay offers their MBG and they tend to always side with the buyer, you should be covered. It's really going to be your word against the seller's but you have the MBG on your side.
The longer you wait it may bend things in the other direction so call them tomorrow and start the process. Best of luck to you....

What kind of case did you file?
It should have been Not as Described instead of Item Not Received (since tracking shows you received the items.)
Since you mentioned ebay generating a label, it sounds like you filed a Returns Request. You cannot file a Returns Request if you did not receive an item. It sounds like ebay thinks you want to return everything for a full refund.
We really need more details for an accurate response to the situation.

Perhaps you missed the point. They are individually invoiced items. Returning a seperate item doesn't ping with ebay returns that I returned this one. The case I opened against them was for the item I paid for and did not recieve. They simply uploaded the tracking to the item for the other items. The others I paid for I have received though sans my promise of combined shipping (scummy but seperate matter).

If the items were invoiced and shipped as separate transactions, a SNAD was the wrong type of case to open. An INR dispute would have been the correct one since each transaction is separate.
If it had been a combined shipment, a SNAD would have been correct and you would have to return the entire shipment.

I initially opened an INR dispute but was told to close it twice by ebay because of their tracking error.
Honestly it's a clear case of MBG but they unintentionally stumbled thru incompetence into a way to game system.

P.s. I like your quote. But I also went to college on scholarship so please dont tell me I did something wrong when we both know the real problem is lack of human oversight messing with the 'mix of the cake's when I follow ebays directions and rules.

Hiring a lawyer or to be more exact going to the two I have in house. I cannot believe after ebay has warned them multiple times they refused to ban them from platform and instead continue in bsing. I am simply done after 10 calls and 5 emails a day at 2 in the morning on weekdns holidays and living in dread of the next effing **bleep**.
Goodbye ebay. It was nice to know you. Since as someone who does customer service for a living I have never seen such blatant disregard to a liability issue.

It will be interesting to see what advice an actual lawyer provides and how that helps resolve issues?
I suspect the seller is employing a tactic where they get under the buyer's skin and irritate them enough that they just give up or get emotional and do the wrong thing and lose protections.
From the aspect of irritating the buyer it looks like the seller has won!
