have an open case for returning a damaged item, seller don't want a return and I'm trying for the last 15 days to ask eBay to help. I'm following all instruction but no option for help only option is giving to close the return case. Any help. It's very strange

Something about what you have written does not make sense.  Did you open a case in the Resolution Center? What were the dates?  Was a label provided?  Did you ship the item back? Does the tracking show the item was received?  What eBay site did you buy from, seeing that you are in Malta?

DO NOT CLOSE A CASE UNLESS YOU ARE 100% SATISFIED.  Closing a case and you will lose protections afforded by the MBG.

Yes very strange. On my resolution centre is saying no open cases but on my eBay is saying you have a case for a return waiting for a response from seller. I'm very confused

I noticed you were in Malta. Which eBay site did you purchase from? eBay.com (The US Site) allows you to escalate a return after 3 business days. If you purchase on an European site, some of those sites, due to local country laws allow sellers 7 business days or even 14 business days before eBay can step on. This board you are on is for eBay.com (US Site).

If you have a return open which it sounds like you do, it should give you a date on "See Return Details" that will let you know when the seller has to respond by (and the day after that is when you can ask eBay to step in).

Also, not every site has the eBay Money Back Guarantee, so it's important to know which site you purchase from because not all of them will allow eBay to step in (that is part of the "where prohibited by law" comes into play).
