Hello. I have been selling vintage car parts on Ebay for a long time. I certainly get some returns for thing that do not fit, no longer need, etc...and I gladly accept them as a cost of doing business. I recently sold a turbocharger for a Mercedes diesel that I removed from a running vehicle that was in excellent shape. The buyer returns the item and says that a part of it was cracked..no big deal I will refund them when it arrives..I open the box and it has clearly been disassembled for some reason...yeah sure it is cracked now that you attempted to take the item apart and did not know what you were doing. I'm guessing I am out of luck from what I have researched...and have to take back an item that is now useless. Am I correct ?

Unfortunately, you are indeed out of luck. eBay's claims of seller protection policies is a joke. If a buyer wants to return an item, all they have to do is claim it arrived damaged and you will be forced to pay for the return shipping. Doesn't matter if the buyer damaged the item. Doesn't matter if the item isnt damaged at all and the buyer simply changed their mind. Heck, they could send back a box filled with rocks and keep your item. You as the seller have no option but to eat the loss. eBay couldn't care less about protecting sellers from dishonest buyers and outright scammers.

Ebay took the money out of my account immediately. There's a $375 loss. What a joke Ebay has become. That was theft.

Take a picture and report the buyer.
If everybody just goes "oh well" and does not report this kind of fraud, what do you expect eBay to do for you?

Taking pics and reporting the buyer accomplishes nothing! I sent pictures to eBay of an item that the buyer claimed had been crushed in shipping, that was returned in the exact same condition it was shipped. The pieces the buyer claimed were lost in shipping? Right there with the returned item. eBay's response to those pictures and my reporting the buyer? Refunded the buyers money in less than 30 minutes. eBay knew the buyer was lying. eBay knew the buyer had abused the return policy. eBay simply doe not care about the small time seller any more. They could do something about these things; they choose to not do so.

Trust me. I have reported the buyer and Ebay says sorry that there is nothing they can do. The Ebay rep stated that my pictures prove nothing ? ummm you can see parts are missing. I have sold over $600,000 on Ebay and they don't care. I'm a reasonable person but this is just awful.
