Damaged Screen

I bought a phone and the seller’s auction was that the phone had no damage or scratches.  I looked at the pictures (he had only two, front and back),  looked like a good phone in good shape.  I asked questions about the phone if there was a lock or damage and he replied that there were no damage and all is good.  I won the bid and paid for the phone.  Received the phone today and  there was a deep scratch on the lower middle region of the phone.   I contacted the seller and sent a picture of the scratch and basically gave him two choices discount the purchase of refund.  He refused both offers.   As a result, I decided to seek a refund through eBay.   How do you feel about my approach? Do you think this was a fair approach?
