1 : buyer opened return with reason (item is defective)

2 : i requested from buyer more info on return and pictures (nothing was provided by  buyer)

3 : i received the item from customer ( item is used but not defective)

3 : i call ebay and was suggested to contact buyer to keep the message on record so i can be protected

4 : buyer not replying  me and (issuing of refund  period is running out) i have two days to issue the refund or represent the case to ebay.

5 : my question is if i represent case to ebay so will it put defect on my account? case is very clear buyer is not co-operating.

Buyer does not have to cooperate, and you have no evidence from buyer that the item was not defective.  In other words, it is the buyer's opinion that the item is defective, and so eBay will back the buyer's claim.

 

Refund the money, close out the return, report the buyer as being a bad buyer, and move on.  If you contest this, you will more than likely receive a defect ... it is not worth the chance.

If you go to eBay - 1) YES, you will get a defect

 

2) eBay WILL side with the buyer and force you to refund.

 

eBay always takes the buyer's side, no matter if they lie or not.  Don't contact them, just give the refund.

Misuse of the MBG.  Nothing was wrong with the item.

I will report that after asking many times buyer didn't provide me info on return and seems try to scam me and used the item badly, used item return is violation of return policy itself.

i received the returned item, and its not defective and he used the item,buyer played dirty game, but thank you for your suggestion i am going to block him and report him. this is what seller can do , ebay should take some serious action against such kind of bad buyer, not only by words by some action. helpline page is saying seller is protected , my case is clear , there is no seller protection unfortunately.

eBay does not protect a seller financially ... that is, eBay will rarely cover financial losses of a seller.
