Can a buyer mark an item as shipped if it hasnt

I bought a very expensive pair of boots on ebay, I'm very leary of buyers I haven't bought from before they marked it shipped but no tracking details. I messaged the seller twice inquiring about a tracking number and after two days they finally replied with they will provide a tracking number in one to two days, also the seller sucks at communication, am I just being paranoid?

A buyer cannot mark anything as shipped.

 

A seller can, but not all do that immediately and not all sellers will use tracking.

 

Relax and stop hounding them, not all sellers are at their keyboards all the time. All that matters is that you receive it in the time allotted. If not, come back here.

 

*ETA* What is their handling time?

Under eBay's system, once a seller purchases a shipping label, eBay records that as "shipped," even though it is not.

 

Sellers have NO way to change this, and there have been numerous complaints for years requesting a change in information, e.g., "address label generated," rather than "shipped."

 

Many sellers on eBay are only "occasional" sellers, who have full-time jobs and/or family responsibilities; and thus  do not look at their eBay sites as often as they perhaps should.  You might also be dealing with a seller who is over-scheduled, or going  through a strenuous series of events, or even an illness.  Please don't jump to any conclusions, based upon a shipping label and two emails.

 

Remember what Atticus told Scout in TO KILL A MOCKINGBIRD:  "You never really understand a person until you consider things from his point of view. . .until you climb into his skin and walk around in it."

You made a purchase from a seller on eBay.

In the listing, you saw an estimated date of delivery.  By making the purchase, you were agreeing that that date works for you and that you are satisfied to wait until that date for your purchase to arrive.

As others have mentioned, eBay is the one who marked it as shipped, not the seller.

On eBay, there is no requirement that a seller ship immediately.  Basically, the only requirement is that the buyer receive his purchase within a reasonable few days after that last estimated delivery date.  Due to the current state of the USPS, we usually recommend that you wait a few days past that EDD to open a case.  A buyer has 30 days past that date to open an INR case.

If that doesn't happen, the buyer can open an item not received case.  Basically, eBay has your back.  Please take a moment to read eBay's Money Back Guarantee for buyers.

Buyers cannot mark items as shipped... only a seller can do that

It's obvious you meant to say seller, not buyer.  Yes, a seller can mark an item as shipped without providing tracking.  They probably do this to provide "same day shipping" and then they actually ship later once they provide tracking.  Not the best way to do things, but have seen this many times

I've had this happen.  Once the seller's acccount was hijacked and I got a refund after nothing arrived. 

 

However, another time it turned out to be a seller drop shipping that didn't have the tracking yet to add.  (In my case it was delivered via Walmart!)  In that case, I got everything in a very timely fashion and was happy.

It is kind of fraud to mark as shipped when in fact the seller doesn’t even have the item for sale, this is happening to me.

Don’t mark as shipped when it is not especially if you don’t have the item for sale. Buyers who pay have the right to have their paid goods sent out and delivered within a reasonable time period. EBay delivery time estimates are totally unreasonable. 
I made a guest purchase on eBay UK and my order was marked as shipped as soon as I placed the order and the seller admitted not having the item for sale he stated that eBay told him to do so. Now i can’t contact eBay UK or the seller concerning my order. I now have a case open with eBay.com Canada.
