Buyer wants to return item that wasn't received on time and supposedly isn't the right color

A buyer purchased my item (a necktie) and I dropped it off at the post office on the day he bought it. Unfortunately, USPS took forever to deliver the package, but eventually did deliver today. The buyer opened up a case against me yesterday saying he needed it "within the next couple days", that included today, otherwise he would no longer need the item. That message is recorded in the case he opened up. Ultimately, it wasn't my fault and there was nothing I could've done differently to ensure it arrived earlier.

 

However, now he's insisting it was too late even though it delivered today (which was during the time window he needed it by mentioned in his case) and needs to return it. He also claims the item was not as described because he was sent a photo of the item and it looked grey and not pink like described (consider that colors don't always appear true to life in photos). In my listing, however, I listed the color exactly the same as the official color name that was labeled on the tag and on the brand's website, and included photos as well. In regards to the 'item not as described' issue, I feel like the responsibility falls on the buyer to make sure the item was what he wanted (especially considering I included the exact details as provided from the item manufacturer) as I did everything correctly on my end. 

 

All of these things considered, I held my end of the deal as a seller, did everything right on my end, and I've been very responsive to messages. My listing also clearly stated no returns accepted, and I really can't take the item back because I've been trying to sell and get rid of it for a while now. I explained all of this to the buyer, but is there anything else I can do besides convincing him to keep the item and resell it if he doesn't want it? Please help, thanks.

Your no return policy has nothing to do with a not as described return.  You are free to try to talk them out of it if you wish, but you do not get to decline the return otherwise.  It is the ebay money back guarantee that covers this sitation.

 

I agree that color shouldn't be a reason to fill a not as described case, but personally, this isn't something I would try to fight and certainly not let ebay get involved.  Thank goodness it is a cheap shipping item and not a bowling ball.

Thanks for the response. It was a Burberry tie though, so certainly not cheap and not easy to sell. Anyways, the case the buyer had opened against me was an 'item not received' case, but since then he has received the item, and tracking details confirm it. Should I contact eBay to close this case since technically the item was received? That's not an acceptable reason for requesting a refund, is it? If he really wants to return it because he didn't like the color, he would have to open an item not as described case, correct?

 

Honestly this is frustrating to me, I really aim to please as a seller, but I have absolutely no control over how long USPS takes to deliver and therefore it shouldn't be my responsibility to resolve that issue.

I misunderstood the type of case filed.  I read not as described and didn't see not received.  Yes, I would enter the tracking and have that case closed in your favor.

 

If you allowed returns, then the buyer could return on their dime, if you set it up that way.  Otherwise, some buyers can be less than honest if they really want to return something, and have been known to make up a reason.  It's unfortunate.

 

Trust me, I understand your frustration.  No seller wants their stuff back and we are all pretty much dependant upon others for timely deliveries after we do our part. 

 

When I get a return, I grumble and relist it a bit higher to make myself feel better.

Input the tracking showing delivered and the case will close in your favor. Buyer can also go to paypal now and open a claim there. They have to pay return shipping. If they return the tie you will have to refund. No returns doesn't mean no refunds on ebay.

Although I do agree with your position.

I suspect that if the buyer does file a PayPal not as described case you will receive a return of the item and the buyer will receive a refund.
