I recently sent out two packages and mixed up the address labels. The wrong items went to the wrong buyers. I contacted both parties and discussed the mix up. Buyer number one understands and agrees to either send it back for a refund or send it directly to buyer number two for which I will compensate him. Buyer number two does not wish to cooperate. He simply wants to keep the item and not apply for a refund/return or send it to buyer number one. So my question is if a buyer receives the wrong item, do they have the right to just keep it? And not pay for it?

Law is involved with this and it is one the side of the buyer:
Old days a switch was used so a scammer could charge the customer more.
You sent them a free item is what it says since it was not what they ordered.
Oh and you still owe them the original item also.

I avoid this possible nightmare by completing 1 order at a time. Pull merchandise and box up #1 order. Print #1 label and attach to package#1. Go to order #2.
Sounds elementary, but it works for me.

Well, I’m only out 30 bucks. He’s not screwing me, he's screwing the other buyer and I can’t send him that item. This was explained to him in a polite and tactful manner.

Thing is...he doesn't even want the other item. He just doesn't "feel" like driving to the post office to return it.

Yeah, no accounting for a conscience these days! Sigh.
On a side note I had this happen to me once. As a result, I put together a checklist of steps to take to process orders. That way I just follow the checklist and in spite of phone calls, people bothering me or having to duck down when there is gun fire outside, I can get temporarily distracted and get back to shipping without losing my place and without forgetting anything or messing up.
For me the key was figuring out how this happened and what were the contribution factors. Once I did that I was able to zero in on a plan.

I understand. My problem is that I'm just retarded. I just wasn't paying attention. Either that or I was off my meds. Or both. Likely Both.

Not unless the buyer opens a SNAD and returns what was sent to them. Otherwise they are accepting what the seller sent. Why would the OP send them anything else?

He doesn't have to. All he does is put the label on and USPS takes it from his porch.
