Hello fellow eBay sellers, so I sold a factory sealed DVD here about Alaskan National Parks. The buyer received the item as described and left positive feedback. Then the buyer open the DVD and watched it. They then put in a return for the item not as described because the film was more about the animals in the park than the actual park. I contacted ebay and spoke to a team member and was assured that this isn't a valid reason for a return and to not accept it and after a few days, ask them to step in and they will deny the return. That is exactly what a did. Then eBay made me accept the return. It's not the money, it's the point that if eBay allows this, I'm done selling here and other sellers should be warned of this scam. I'm just so disappointed with eBay right now. Is this mail fraud as well? Any advise?

Sorry this happened to you. Put the user on your blocked bidders list.
eBays buyers guarantee out does what ever the seller says or does in most cases.

I'm sorry that happened to you. I agree it's not fair for that to happen. I have a little more bad news for you though. Since you didn't refund right away, and eBay had to step in and found against you, you also got a defect on your account - check your performance to see if it's true. Also, I think under the new Managed Payments program, there is a $20 fee for eBay having to resolve a case against you. If you are still under Paypal, I guess this won't apply to you. Sorry for all this for you. You can try to appeal it. Good luck.

I am so sick and tired of eBay reps telling sellers LIES. And further, when a seller acts on their lies they end up with a defect on their account. YOU EARNED A DEFECT FOR A CASE UNRESOLVED BY THE SELLER WHEN EBAY STEPPED IN TO RESOLVE IT. Refusing a return for not as described is USELESS. You will be forced to refund the buyer if they claim not as described. ALWAYS.
eBay doesn't require them to prove it's not as described. eBay can't tell if they're lying or telling the truth. They don't care who is lying or who is telling the truth. The buyer could have said it was defective and returned it in perfect working condition and eBay wouldn't care.
Know this------- and it is true information--if a buyer files a not as described dispute you must accept the return and provide a return label, or you may choose to save the return shipping money and issue the refund and let them keep it. Those are your only choices to resolve the return without a defect on your record.
Selling books, CDs, and DVDs on eBay s risky. If you had a mom & pop retail store not too many people would return a new book or DVD with such a stupid reason. Some people would find it hard to look you in the eye trying to explain they wanted a refund because they didn't like the movie. That's sooooo lame. On eBay they don't know you and don't care to know you and they don't care if you block them after a return. I'm sorry you encountered such an unethical person. They probably get free food as well by eating 3/4 of their Whopper and then complain they found a hair. My brother knew a long distance truck driver that did that at every restaurant he ate at.

I would appeal the case to ebay. That is ridiculous.

Thank you so much for your advise and feedback everyone. Greatly appreciated and insightful. So after I posted this I tried to call eBay unsuccessfully. Then I sent a message to the buyer and called them out. I already cancelled my store a few weeks ago here, and I decided to end all my selling on eBay for the time being after this incident. So this was my message to this buyer;
Hello, can I ask, what the heck is wrong with you? This is your reason for a return? Seriously? Way to completely screw the little guy trying to make a couple bucks on eBay in tough times. for $8.50? eBay told me this wasn't a valid reason for a return and to ask them to help and they would deny your return. But of course eBay is unorganized and you were able to pass your scam through. Congrats! I'm looking in to filling postal fraud charges on you. I can't believe you think this is acceptable. -
After that, the buyer did not reply, but they did cancel their return request and close the case. I think they thought I would just immediately give them a refund and let them keep it for free. It wasn't the money that mattered here at all, or if eBay puts a strike against me, but if eBay allows this type of nonsense to go on, then I'm taking a break from selling here, especially in quantity. I was going to delete this post after I resolved the situation, but I want everyone selling here to be aware that they would tell me on the phone one thing and write notes on it, and then do the opposite when I ask for help. Plus, if this is a valid reason for a return, wow, unbelievable! Stay healthy, safe and happy!

I sell a lot of DVDs and this has now happened to me twice in the last couple of months. Total **bleep** I can't believe there are more than 3 (my two and yours) horrible buyers out there who think this is ok. Unfortunately, the rest of the people who commented are correct, there's nothing you can do about it.

Years ago, when I worked in the Music & Movies Department at a large Barnes & Noble store, a customer bought a DVD copy of the first season of "The Martian Chronicles." A couple days later, he returned it opened, claiming that it was defective. The policy at that time was to only accept the defective return in exchange for a new, unopened copy of the same item, which I did. And the next day he was back, again claiming that THIS DVD was defective.
Having waited upon him twice by now for the same defective item, I was curious what the problem may have been for both copies -- and I was floored when he stated that he didn't like the manner in which the first scene had been filmed & directed, and was hoping that other copies might have featured an ALTERNATIVE scene.
I tried to explain to him that there was only ONE version available of the DVD set, but he wasn't listening, and demanded a refund. I reminded him of our refund policy on defective items, and that what he had complained about was not a defect.
He threw a few things, swore a lot, questioned my birth legitimacy and my mother's ancestors, and swore that he'd never shop our store again.
I thanked him, and he left.
