a buyer opened a return request on an used computer router i sold, the reason is: Doesn't work or defective
the listing was not accepting returns, i sent the buyer a message asking what was wrong with the item since i have tested it myself and it was all good, his answer is there is no problem with the functionality of the modem but there is a stain at the bottom that can't be cleaned. in the listing i described the item as having signs of wear and the pictures i posted clearly show the stain, i feel like it is a scam and don't know if i can challenge this since the buyer is saying the item is working.

There is no such thing as no returns. If in fact the buyer states it is not as described, request that it be shipped back to you and you can send them a return label. Please read information on selling. VERY IMPORTANT, particularly if you are selling electronics!
I would change you listings.

the thing is he's not stating it is not as described, he's saying the item is working.

If he/she states that is it not working, it is not as described. Electronics are not my thing, but reading the boards, I have seen many issues just like yours that don't end particularly well for the sellers. As stated to others, only sell items that you can afford to lose on. I am paraphrasing.

You can, but it won't turn out good for you.
Ebay can refund the buyer from your account, let them keep the item, give you a defect fro not handling the return and they'll keep their fee's.
Accept the return, pay return shipping and refund the buyer when you get it back.
Once the buyer is refunded and the case is closed, then report the buyer for abusing the MBG.

Doesn't matter if item is working or not. If the buyer claims that is Not as Described, you will need to send him a return label and refund him when you get it back. EBay doesn't know, and really doesn't care if it's working or not. They will refund the buyer and let them keep the item if you don't respond in time by accepting the return and providing a return label.
As mentioned above, no return policy does not matter in a SNAD case. If you fight it or don't respond in time, you'll also get a nice defect.
At least you'll have the chance to sell it again if gets back to you in one piece.

he's not claiming it is not as described, he opened the claim as an item not working or defective, when i asking what was wrong he says it is working but i has a stain and doesn't want it because of that.

It does not mater what they are saying,
the case is open.
Your choice is to refund, or return for refund.
Ebay has no idea what you sent. Case is opened.
If it goes to eBay choice you will most likely lose.
You could try and get a CS rep on the case but it is most likely they will find for the buyer.
It is very rare a case does not go to the buyer due to eBays buyers guarantee.
If the item cost to return in not worth it refund.
If is worth it to get it back and still have a few options return for refund.

If the buyer opened a return and stated the item is not working or defective then your only choice is to accept the return and request that the buyer send your router back (if you want it back). Otherwise the buyer and eBay will consider it a gift to the buyer. This might be the outcome your buyer is hoping for.

Accept the return, then describe that stain next time you list it. It actually looks like a burn mark.
