Bought a used graphics card DOA, request for refund

Hi, guys. I am bothered by a problem.

 

Early in this month, I bought a 1080 ti from eBay. Seller has his item descripted as fully functioning, not used for mining and overclocking. Price is not very cheap, even higher than the original price he bought it, but still cheaper than new one after GPU price lifted. He mistakenly titled a cheaper model but then we've cleared in private messages.

 

I received item 2 days ago due to international shipping, I plugged it to my pc, powered on, then, a dead on arrival surprise.

 

I have to clear first that I am not a computer noob, I know the correct way to clean the old drivers before installing a new gpu, connecting the 8+8 pin cables while power is cut, etc.  I use a Corsair HX750i PSU that could output stable power, no chance it will damage a high end video card; motherboard is made by ASUS ROG, BIOS is compatible, so no problem either. I first assumed it was not a hardware defect and have tested in a dozen ways to make it work ( of course no harming ways ) but no lucky.  My PC was and still is working with my old video card. Next day, I brought it to IT service center, staff member told me the card is apparently dead.

 

I contacted with seller, he claim this card has warranty that he could help me with RMA, I have to ship it back to him and he would like to share my shipping cost. But there is one problem: RMA will take more than 10 days, after that if anything happens like package is lost, damaged in shipment, etc. eBay protection will not cover for it.

 

After confirmed with manufacturer I opened a case for return & refund since I thought it's a better solution: I bear the returning shipping cost, he refunds me, and he can inquire RMA later, no extra charges for him, video card looks exactly as first time I got it.

 

Soon he rejected my request and re-offered a lowered price. I purchased at $807, he offered me $700 as refund that he thought it's fair enough.

 

I can't accept this, seriously. He did spend his time to help me, like he changed address label for me because I placed the order in wrong address accidently -- that was my bad, I can minus that cost for him if he asks.  He's a enthusiastic guy, but it can't be the reason for $100.  PayPal adviced me to escalate the case that after investgating they will force to proceed a returning progress. I don't think my seller sold me a faulty item on purpose, there might be other reasons caused damage ( either I would do so, if I don't like it I can sell it to local people anyway, not breaking it and paying $60 to ship it back ) . He has 100% positive feedbacks on ebay while I am just new member, probably it will effect his credit, I don't want to start an arguement. 

 

He looks not happy and ignored my messages, what can I do now?

You should have filed a SNAD complaint with eBay so the seller would have to pay for return shipping.

Did you have the item shipped to a US address and then forwarded out of the country?

 

if the seller approved the return request & hasn’t paid for return shipping, you have to ask eBay to step in. Forget the partial refund nonsense and ask eBay to step in.
