I recently had a transaction as a seller where the buyer totally lied about the item. I called ebay to talk to a rep and they told me if I dont believe that the outcome is fair and I could prove it that I could always appeal it. Another total lie. Why does ebay even have a appeal if sellers can not prove to ebay that the buyer is a total fraud????

Sorry this happened to you, but your obviously operating under some type of misunderstanding. In ebay's eye, you as the seller, will always be in the wrong. Just think Napoleon Code, you're always guilty until proven innocent, and while the jury is already tying the rope even before the trial starts. This is ebay and if you're going to sell here you have to know the rules. The biggest one being: You're Always Wrong and aways at fault.

Great reply...however it may prove to be too subtle for the OP.
Seems it is always those who choose to ignore policies & have meaningless & unenforceable TOS end up having issues...jmo

Without details of what exactly happened, you might try calling paypal to confirm delivery or request that the item be returned before paying the refund.

So Ebay used to appeal cases as I have been through a dozen or so. Always found in our favor as we always try to do the right thing, but we are not giving away stuff.
However just recently (yesterday) Ebay advised that they can no longer apeal the original decision. I have looked and can not find this anywhere. Her is the response from Ebay,

However, we believe that as a good customer service to a customer, it is the seller’s responsibility to ensure that the item will arrived on the condition they’ve expected from your listing. Since the buyer claimed that the item they received is not as described on your listing, I hope you understand that the best thing that we can do to resolve this matter is for the buyer to return the item to you. I know you can understand that we need to follow some guidelines and policy on our site in resolving such cases.
If an item has to be returned because it doesn’t match the listing description, we require sellers to pay for the return shipping, even if they don’t offer this in their return policy. This ensures buyers don’t incur an extra expense as they work with sellers to make things right.

Really, the item was shipped back to me and was in the same box and packaging, was absolutely as listed. Buyer did not claim not working or used, just not as described.

What kind of line is this. I contacted the buyer 12 days in a row and never received one response from them. Ebay hits me with the defect for not working it out.

@rixstuff why would OP call paypal? This was an ebay case. Did you read the post?

Seriously? They will not appeal anymore. I have never had a single transaction ever go to unresolved. Therefore no experience at all with an appeal. Ruled in buyers favor over INCORRECTLY specifying reason for return, not as decribe to avoid return shipping. Buyer thought they had paid to much and wanting big refund. I offered return, not refund and keep, they did not want to pay simple insured return 10.00 shipping. It was all stated in their communication thru Ebay messages.
Any luck with defect removal on something like this?

The lack of thier (buyer) response......I have ebay emails to prove ebay even acknowledges it
The proof that Item was not as described.......What they sent back to me was exactly what I sent them and was exactly what was described. Have a video of me opening what was sent back. I put stickers on all my items when they go out. Stickers were there, Item was exactly as described, the only difference was the item was removed from sealed plastic wrapper.
Again stoked about forcing the return, but more stoked that Ebay has accessed a defect against me.

Been doing this for a while. What I now having issues with is "Ebay No Longer Appeals its Cases"
Read the underlined statement. When did this start? I have done this before and never been told they will not appeal an original decision. I am asking the community where in Ebay's vast rules does it say this? This is something relatively new to me.
I understand the Napleon Code you speak of.....Ebay has always been that way, and I have learned how to deal with that, but this one is new to me.....

So what do you want. A video of me opening the package mailed back to me from the buyer that shows what was in the package.....exactly what was described and what was sold and then sent back. Not one thing was not as described. I put my own proprietary stickers on my products and they were on there.
See the product I got back from the buyer was exactly what I sent and was returned to me. I have a video of the transaction. What more proof is needed?
I have the email transactions or attempted transactions with the buyer all through Ebay.
What else would you like....what am I missing.
