Advice on how to approach this return

So I bought a gpu here and was very excited to try it out. The seller advertised it as new with a full 3 year warranty but without the box. When I contacted the seller, after purchasing, about the warranty he said that he wouldnt be able to provide a receipt and basically revealed that we were already well into the warranty period because in cases like that the warranty starts on the manufacturer date. But i figured it would be ok as long as instill had like 2 years on it. 

 

Anyway, the package got to me early which was nice, but no matter what i tried, it didnt work. I troubleshooted all day with a friend a who works in IT and we determined it was dead. 

 

So I contacted the seller and he wants me to go through the warranty. When i tried contacting the company, they said it could take a month for them to get it back to me and that there was no guarantee that they would actually fix or replace the item. Which was surely put me out of time window for ebay's money back guarantee policy.

 

Should I be taking the risk of going through warranty or should i just contact ebay and report SNAD since the warranty wasnt as he advertised AND since the gpu is broken?

Forget any warranty.  There is usually no warranty unless the seller is a licensed dealer of the brand.

As ZJame234 Said, don't wait, don't hesitate. This is not your problem.

File a SNAD and send it back to the seller. Let the seller deal with the warranty. Most warranties on items like this are non-transferrable and apply only to the original buyer and typically require the original receipt for purchase or the appropriate warranty registration card to have been submitted on a timely basis to the manufacture.

Your seller instead of doing the right thing and advise you to simply return the item as a SNAD, has put his best interests before yours, & wants to make his problem, your problem to resolve . 

Very poor customer service. IMO
