10 days to create shipping label!

Starting to think I’m being scammed and would like some feedback. Purchased an item on 3/16 and paid immediately with PayPal.  Add stated it would ship usps priority and should be there by 3/25. Seller immediately emailed after sale stating he would ship out on Monday... I contacted seller twice during the week asking for tracking info with no response. Today 3/26 was the 1st day I could use the eBay resolution center so I filed a report stating I had not received a package or confirmation of shipping. A few hours later the listing was updated with a ups tracking label that was generated today!  I’m assuming this is some sort of a scam to draw out the timeline for refund? No one would really expect you to wait 10 days to ship correct?

Most people would not wait 10 days for a seller to ship.  Keep on top of that tracking number and you can Ask ebay to step in if the package does not arrive within a week.

Nope, actually the scam is NO DEFECT if the seller

1. doesn't ship,

2. waits until the buyer starts a refund request,

3. then refunds before the buyer can ask eBay to step in.

 

Because uploading tracking now, after you've already started a refund request:

 

Upload tracking to prevent "item not received" claims

Starting September 10, 2018, you will be required to upload tracking in the structured data field before the estimated delivery date has passed [otherwise] eBay will not protect you from a claim

I'm not sure what the new policy has to do with the no defect "scam"?  That way of getting around defects has been used for a while.  And uploading tracking isn't necessary to do it.  there have been sellers who wait to ship until a case is filed then they win when it shows delivered, feedback can't be left, and opening a not as described case is more difficult   with the new policy sellers who do that should be losing the INR. Personally I think it's why the policy was put in place

There was an estimated delivery date seen in the listing where you made your purchase.

If that date was March 25th, that's the date eBay uses to evaluate an item not received case.

You can open an item not received case now, or you can give this a few more days.  But, no matter what you do, March 25th is the estimated (more or less set in stone) delivery date.

So now it looks like seller has shipped “something” as I can track the package and see it will be delivered next tuesday.

 

can I still continue with the resolution case for a refund? I already had to purchase another item as I couldn’t wait  any longer and was sure I was being scammed.  I had started the case yesterday morning and it states the seller has 3 days to respond which they still have not they have only shipped what I assume to be my item but who knows why it would take 10 days!

Yes, as you see on your refund request @madscientistmike come back to that page this Saturday March 30 to click Ask eBay to step in, and eBay will make a decision.

Can I leave it as an item not received complaint even thought there is finally now an item in shipping or do I need to change it to a refund request

That's also a scam: Sellers know you don't know, and hope you will close the refund request since the now-provided tracking shows something on its way somewhere.

 

You should escalate the request as scheduled. Then several scenarios:

- eBay refunds, and the item arrives late:

-- You decide to keep the item, you repay the seller.

-- You start* a return request for Does not match description**

*eBay allows you to start a return request after a refund request

**eBay considers the estimated delivery date a part of the description

- eBay refunds, and the item arrives somewhere else:

- eBay delays, the item arrives late, and eBay doesn't refund:

--

- eBay delays, the item arrives somewhere else, and eBay doesn't refund:

-- You tell the seller to send a prepaid label to get it back

-- You refuse the package (you already have a refund)

If you start a return request now, you may not have anything to return.

What a joke! Seller took 10 days to ship, it took another 7 days to get to me and never once contacted me to explain why it was taking so long... Ebay sided with Seller because it eventually was delivered!

I believe you can open a NAD case for late delivery.  It won't hurt to try.

If the seller's handling time was 10 days, any buyer should expect to wait 10 days for the seller to ship it.

I'm not saying that's what happened here, but YES, it can happen that a seller waits 10 days to ship the item, and is perfectly within his handling time if that's what he specified.
