third party got delivery buyer opened a return case

Hello to all,

Buyer claimed she is travelling and one of her friends got delivery (in buyers name)

Her friend claimed send photos to the buyer and buyer opened a damaged item return.No way item damaged on delivery,for 2 days delivery.

From now,is there any chance to win that case as a seller,as a third party involved in delivery?

I know the policy for a third party delivery,that buyer is covered in first point adress delivery.

But i didnt find any info what if a non relative receives delivery.

If someone really wants to help,appreciate,

If the buyer opens a return request because the item is not as described (damaged).  You need to resolve the issue inside the request details.  Lots of buyers buy things and then send them as gifts to friends and family.

 

You can either just refund if it is a low cost item or accept the return request which will require you to pay the return shipping. 

 

If you do nothing it will eventually get escalated into a case which means both you the seller and the buyer have given eBay permission to make a decision on the case.

I know how returns works.

My question is "if there is any chance to get covered from ebay that a third party got and opened box,which was on buyers name?"

I didnt ship item in an adress of buyers friend,and in Europe its illegal to get a signature box if you are not actual the receiver.

No I do not think that matters.  eBay allows buyers to change the address to a third party and I have never read anywhere that terms of the MBG changes when that happens.

Also the original buyer had to open the return request because the third party would not normally have access to the buyers account.

maybe my english arent very well to get complete the point.

I didnt ship in third party,but third party in buyers adress opened box and send photos to buyer.The box need signature and only id holder can get it.

Third parties delivery like forwarding mail adresses do not covered from ebay.

Covered only to first delivery point,and not to actual buyers place.

I realize this is probably not what you want to hear but,  If you think there is some kind of loophole because a different person than the buyer received and opened the package then I would talk to the carrier about the signature, that is an issue with your carrier not eBay.

 

When you listed the item for sale on the eBay platform you are basically agreeing to the MBG terms.  If an item is delivered damaged and the buyer opens a return request you need to resolve the request.  Only the buyer can open the request.  If you do not accept the return eBay will step in and decide in the buyers favor and they will refund the buyer and let them keep the item.

 

Your actions will determine what happens.  If you do nothing eBay will consider since you did not accept the return that you did not want the item back.

 

If you get it back and it is not the same as you sent it, you can report the return to eBay who will review the details and take action if they need to.

Being that you are located in Greece you might want to ask your question on the board of a EU member country rather than this US one.

 

However, there is no way that you can know for sure that the item was not damaged in transit so you have no real option but to accept the buyer's word and advise them to return for a refund.  I'm not sure if it works the same in your country since some EU countries have quite strict consumer protection laws, but here on the US site you are required to pay the return shipping.

 

With regard to the third party accepting the delivery, here in the USA you can restrict delivery to the person to whom the item is addressed but again, I'm not sure about your country.  However, since it is the buyer that you are dealing with, I see no problem.  The third party seems to be handling things properly by notifying the buyer and letting them handle the situation.  That is assuming that the person that opened the package and discovered the damage had the permission to open it from the addressee.  Basically, it is merely another SNAD dispute and needs to be handled as such.

1.  Ask your buyer what is the specific damage, send you pictures of all damage to the product, and pictures of the interior exterior packaging.   

 

2.  Dig deep into your buyers feedback and purchase history, check to see if you see a pattern of making false claims. 

 

3.  Check the tracking on the package, see if this package was forwarded to another person/address other than whom you sent it to.   Call the carrier to get specific information.  

 

 

What was the item you sold?

Did you have insurance on the item?

Who was your shipping carrier?

That seems like something you would have to take up with your mail carrier. I don't think ebay is equipped or cares to handle that level of investigation. Maybe after the fact you would be able to appeal the case if it doesn't close in your favor.  Best just to accept the return.

Depends...

If the third party was a reshipper then you should have little fear as it will be near impossible to return the item to you, however if the third party was a friend or a person local to the buyer then there is a good chance they will find a way to return the item to you.

That having been said, if a return request is presently open you need to ACCEPT this request regardless of details.

Legalities matter little in how ebay thinks this will resolve, whether it is legal in your country or not, ebay won't care.

Accept the request, then wait for the item to come to you.

If the item never arrives, you likely will not have to refund.

If the buyer gave permission to her friend to open the package, then there is no problem. Deal with the return as you would any other return.
