I got an email direct from a company before about a product.  The company said I was charging more than manufactures suggested retail price(MSRP) and it could ruin the company's integrity.  The said that I should change it or be open to consequences.  The item was over 10 years old and has value beyond what they charged and anyway I normally have sales well below their MSRP.  Either way I reported them to Ebay for harassment.  Ebay is the go between.  If they had standing they would have used VERO.

I get Roche's POV, it's a potential liability issue that looms large in medical equipment, but honestly, sometimes I think some of these other outfits just send out these scare letters on the chance they'll scare enough third party sellers off from flogging their products online, which begs the question of - why bother?

 

Some fish, too - a brewery in England in an old village was pestered by Red Bull who decided that their name (I think it was Red Gate) would cause 'brand confusion' (don't ask me what good ale has in common with a drink that tastes like battery acid) - if I recall, Red Bull dropped the suit when they were mocked by a lot of people who actually used their products, but it was a while ago.

"I think that anyone who has learned to type since the invention of a pc only puts one space after a period.  [I think it's easier to read print with 2 spaces ... so I never tried to train myself out of it.]"

 

As a published writer any manuscript submitted has to have 2 spaces after a period.  Not sure about ALL books but the Clive Cussler I just looked at has one space after the comma and two after a period.

I am not the only one whos selling this .Theres tons of seller who sold tons of this in ebay so why me and that item is sealed , its just i dont like their machine cause its sucks and its just sitting here thats why i am trying to sell it to make a buck cause i was in the hospital four times last year and almost die.Why is this person picking on me?He should send it to the ones whos selling tons of it?

Since we are on the subject of style, here's the new style that I proposed - eliminate the "."  and the "return key" altogether they is unnecessary and involved using fingers that are mostly useless on a key board All you need is to capitalize a letter to indicate a new sentence, and two spaces to indicate anew paragraph To wit:

 

Every night about twelve o’clock I slowly opened his door And when the door was opened wide enough I put my hand in, and then my head In my hand I held a light covered over with a cloth so that no light showed And I stood there quietly Then, carefully, I lifted the cloth, just a little, so that a single, thin, small light fell across that eye For seven nights I did this, seven long nights, every night at midnight Always the eye was closed, so it was impossible for me to do the work. @angelheart1435  They don't distinguish between people selling this, just that it's listed. 

1.  You can let it run and see what happens,

2.  Change the "new" designation to "new (other)" or 'open box' and explain that it's sealed. 

3. Take it down (last resort IMHO).*

 

*But I'm a risk taker - I'd want the money out of it and would rather just go along with compliance and get it sold - YMMV.

 

I've been through this before so I understand the frustration, but you have three choices here that I see. 

 

ETA:  What I would do is not bother auctioning it - just sell it normally - it's not a collectible and has a market price and I expect you'll get it sold faster.

I received one these letters also. My first thought was, "who actually wrote this" and that it couldn't have been a actual lawyer. The premise seems to be that once a product is purchased from a retailer, wholesaler or distributor then it can not be described as "new" anymore even if it is wrapped or boxed in factory sealed condition. I'm sure that this definition would surprise millions of sellers and vendors worldwide. Selling factory sealed items even fits ebay's definition of new.

 

It will be interesting to see how any enforcement of this letter could happen.

There still are typewriters, I have 27 piled up in my shed. I also know all eleven people who still use one.

As far as I know, ebay advanced search only has 'by seller' and that doesn't show 'buy only' accounts. And if real ID I think it's for 'info only' and they never list items. Maybe using the 'find store' it might come up.
