So it has been brought to my attention by one of my manufacturer that by August 30, 2018 all of our listings must show the proposition 65 disclaimer in the listing description, at least the stuff that has that on the packageing, but proposition 65 probably is on everything so that would have to go onto all of our listings.
Has anyone else heard this?

And the list of warnings for hotels and restaurants is quite lengthy, with such toxic items as liquor, rice, shellfish, seaweed, mushrooms, pumpkins, prune juice, french fries, olives, nuts, coffee, etc.
This will be right up there with the electric blanket warning: "do not use in bathtub".
That is just so embarassing. Having to put up a notice explaining common sense is just way over the edge.
I smoke. Never, even once, did I ever think that smoking a cigarette would be good for me. I've never needed a warning to tell me that.
And breathing exhaust fumes? Does anyone here think that's a fantastic idea to go and sit in front of your running cars tailpipe?
And wood dust? Regular wood? I doubt there is much of a problem. But I see that there isn't any mention of the new "wood" stuff like particle board, OSB, the new deck boards, and other stuff where it would release chemicals.

I know. I read it. I just don't believe it. They probably did tests similar like all of their other tests - if you snort five pounds of wood dust every day for 50 years, you may get cancer.
But like I said, it doesn't even mention treated lumber, pre-formed 'made-up' lumber like decking, or any other wood 'products' that contain actual toxins that are put in there by the manufacturer.

I'm waiting for the necessity of a tattoo or tag around the neck warning that the people in the State of California may be harmful to the health of other individuals.
On the back of the tag or with another tattoo (they seem to be quite fashionable this century), it will be recommended to always wear protective clothing, respiratory filtration devices, body armour and vision obscuring devices and carry approved substance detection devices when interacting or in the presense of any carbon based unit(s).
The foolishness of one's actions or words is determined by the number of witnesses.
Perhaps if Brains were described as an APP, many people would use them more often.

As a FORMER citizen of California, I personally think it would be more truthful to list the disclaimer as:
"Warning. Everything sold into the Socialist state of California contains agents known to the state of California to cause cancer and birth defects, reproductive harm, or other, as yet unnamed, harm to its citizenry."
Thankfully, I don't sell any products that would apply!

The best piece of information I've seen on this is from the National Marine Manufacturer's website & it looks like a generic warning is not going to cut it. I understand it states we are exempt because our business has less than 10 employees, but since we are selling on the eBay marketplace that has thousands of employees are we liable?

Unless eBay is going to force this, I am going to ignore it and will refuse to engage in a ton of what amounts to only busy work. I owe no fealty to California. If eBay wants to do something, they can create a simple little script with the appropriate wording to inject into all listings.

Actually the wording is incorrect. From August 31st 2018 you must state at least one chemical from the Prop 65 list if you are not in compliance or you can use use a short form statement but you must label your product packaging with a label of a required size with the specific wording from the proposition.

I understand it states we are exempt because our business has less than 10 employees, but since we are selling on the eBay marketplace that has thousands of employees are we liable?
California might think eBay is liable, but my UA with eBay says I'm doing business with a Utah company, so that's between eBay and California I suppose.
California is a bit expensive and ridiculous, that's how eBay ended up in Utah!
Fake silver coins manufactured in China tend to contain lead, cadmium, and other toxic chemicals... does this mean California is going to crack down on fake coins from China that don't have Prop 65 warning stickers?

Seriously though - it seems hardly likely that politicians, more interested in the “big fish” prosecutions that make their careers are going to worry about us small guys. For that matter, how are they even going to know? I will just have them contact my lawyers - Duck, Bob and Weave.

I have spent about an hour on the phone with ebay about this. They said they are not requiring it at this time. As soon as I said "please send me that in writing" they put me on hold and now checking.
No one there has a clue.

I don't know how it got passed here in California as law ,because it was poorly written out and thought out to begain with. I voted No on it .
