I accepted a return on a pair of earrings and they came back badly damaged. They were ahipped back in a flimsy cardboard box which was crushed when I received it.  This was NOT the box I shipped the earrings in. The box I shipped the earrings in was a hard sided, nice gift box, as I always ship jewlery in. If they had been shipped back in the box I sent, they would not have been damaged in shipping.  I actually believe the customer damaged them herself prior to shipping back to me.  I called ebay, uploded photos, reported buyer for misuse of returns, etc.  Ebay says not to refund her money and file an appeal when ebay closes the case. My concern is, if ebay closes the case in her favor I will get a ding on my account. I'm already fuming over the condition of the earrinsg on return mind you. I do not believe this kind of damage could have been solely from the box being crushed.

BTW, I tried filing a claim with the PO and she did not insure the return so I have no recourse with the PO.

ebay may not even give you an option to appeal the refund will just come out of your account and they will close the case and they will say they can't do anything about it. The end.

I talked to ebay twice about this and both times they said do not refund and ebay will close the case and I should then call ebay right away and appeal. My concern is, if they are going to close the case in the buyers favor automatically, why not just look at the evidence, which is VERY clear, and rule in my favor to begin with.  I undertsand the buyer now does not have the item, so should get something back, but why should I have to accept a damaged item and give a full refund?  It's infuriating.

Whatever happens with ebay when you appeal, don't forget to report the buyer within eBay for returning the item not in the condition you sent it out to them in. 

 

I get this all the time when buyers return hats. They don't put it in a box and the hat gets ruined when it comes back.

Sorry to hear about your item being damaged. Returns from a seller's standpoint have become such a murky issue in the last six months. Hopefully they take heed to everyone's woes and make a reasonable adjustment to make everyone happy.

I am with you but ebay has to answer to the credit card company, and if the buyer returned the item, their company will force ebay to refund and ebay will get a defect.

maybe I should call ebay again in the morning and ask if the case can be closed in my favor, if not, I will refund the customer to avoid a ding against my account.

They LIE.  Your buyer could have sent back and empty box instead of crushed jewelry and you would still be required to refund from your proceeds.  That is how eBay rolls now, and why many sellers have left. 

 

You also get a lovely "SNAD" defect on your account for your selling return metrics and no telling what else they have dreamed up since I last checked.

one of the ebay employess said ebay may refund the buyer out of their own pocket, but this is $900. I do not see ebay just giving the buyer this kind of refund. Then again, $900 may be a drop in the bucket for ebay.

yes, this is what I'm afarid of.  I really don't trust what ebay tells me on the phone, as much as I'd like to.  

Has anyone here ever won an appeal for an item not returned in the same condition it was sent?

Unfortunately, the c-s agents you spoke with gave really bad advice. Unless you offer "free returns" there is no other option but to issue a full refund once the return tracking shows delivered.  If you don't do it, ebay will absolutely do it for you and give you a case closed defect. All the prior "advice" from  c-s will mean nothing. 

 

There is the option to appeal, but that's *after* you've issued the full refund and the outcome is doubtful. Not to be a downer, but there is no real seller protection from false SNAD claims or items damaged in return shipping.
