Ebay continues to treat sellers with utter disrespect. Ebay took my money and didn’t even inform me. Case in point
I sold an item to a customer in the states. It was a custom made guitar body. I listed in the description some minor superficial blems using a canadian coin as a reference point. I took 12 high resolution photos and described the item accurately. The item was then placed in a foam sheet, bubble wrapped and double boxed and sent out thru canada post. USPS took over and delivered the item with tracking number.
Buyer puts in a claim. I immediately get a notice email from ebay.. Item not as described. This is complete BS. the choices are let them keep the item and the money, offer a partial refund or send them a shipping label.
I refused ebay’s forced resolution. I appealed the case. I will not play ebay’s extortion game. As you know anytime someone files a claim and paid with prepal, automatically a hold is placed. I escalated this case and actually won the case…So i am thinking, ok buyer keeps the item, i get my money released..Of course this doesn’t happen at all. A couple of days later an appeal was made and ebay reversed their decision..
I call the incompetent philippine center..They can’t read, nor understand cases. Their only job is to close off cases as quickly as possible in the favor of buyers.. They are measured in number of cases and must be closed. I asked to be transferred over to Special appeals in the U.S.A.
Here is an excerpt from the case which I won:
“eBay Customer Support has reviewed the case and made a final decision.
Comments:
This case was found in your favor because this item isn't eligible for eBay Buyer Protection. Any feedback left, including detailed seller ratings, will be removed and won't affect your seller performance standing. Note: It could take up to 24 hours for your Seller Dashboard to reflect this decision.
You can also view the details of this case in the Resolution Centre.”
The other incompetent person who was in the special cases resolution center stated that it was ebay the refunded the buyer but not out of my paypal account. That was a complete lie. I had paypal on the line as 3rd party at the same time and they also confirmed that in fact the money was taken out of my account. I asked to escalate this case to management leader while i had paypal on the line. He takes a look at the transaction and admits that in fact ebay did refund back the buyer but took it out of my account. I asked him why that was. He didn’t have an explanation.. He said that it would be sent to special finance department to review these transaction that occurred thru prepal. He said it would take a week to get back to me.. I asked him to assign me a case number and asked if he would personally send me an email with the case notes.. He said yes.. Of course I didn’t get any email from him despite he giving his word to me that he would. A week passes, I call again, start to play the dog and pony show with the incompetent philippine call center. Asked to speak to the states (U.S.A) to specifically that person i spoke with in management about my concerns. Got to speak to another lad, he check the case notes.. Nothing was put in about the conversation that i had with the specialist and paypal representative a week prior. He said the guy i spoke with had made a decision back to the buyer.. So what happens is that i am out of the item and out of my money. If an appeal is made and reversed back to the buyer you the seller are completed screwed over by ebay.. So case in point, even though i initially won the case, appealed was made and reversed, i am now out of the item and out of my money. Ebay will take it’s ridiculous fees, paypal takes their fees as well.. And i am out in the hole.
Please someone tell me how this is fair in any respect? Ebay continues to treat Sellers with utmost distain. There is no fair play. It is all one sided in favor of the buyer 99.99% of the time..You play be ebay rules and you still get screwed.. Goodwill of a longtime seller means nothing to them. Ebay thinks it has an infinite supply of sellers to rely on.. This is a strawman theory. Sellers are leaving ebay in droves, it is quite evident by in their recent quarterly results. A one sided policy where everything is favored towards the buyer, this creates an inequality.. Ebay is a punitive place, untrusted place for sellers… ebay will use you, they are like a casino, sit back and collect all of their money off sellers with zero risk on ebay’s part. The atmosphere and animosity that sellers regard ebay is at an all time high. I have diversified to other ecommerce sites with some success and get treated fairly. Treated as an asset, not as a supplier or liability.
In summary, buyer kept the item, got his full refund, ebay and paypal took their fees from me and i have **bleep**.. Thank-you ebay for stealing. The Titanic can’t hold any water when their is a gapping hole in it. .

It's never right when anyone gets cheated, be it sellers or buyers here on eBay. However, I would suspect that someone at eBay, despite the initial decision, took a closer look at the listing and possibly because the buyer appealed or made a stink. The fact is that your photos are conflicting when you look at them. One view of the guitar shown several times reveals completely different hues & tones of color. On top of that you state in your listing "Please note that stock photos are used." TBH the photos don't look stock to me BUT you say they are and I would surmise that your buyer does indeed have 2 qualities that enable them to scam sellers like yourself ...
At the very least I would hope you've added this buyer to your BBL.

Refusing to participate in eBay's return process was not an option.
Next time, choose "return for refund", pay for a return label on SNAD claims, and refund in full on return.
CS everywhere is a pain. There are too many people inhabiting the Third Rock ... and making the rest of us wait.
Ikea's Swedish meatball counter - strategically placed directly across from checkout - is the only reason why customers are willing to wait in line for 2 hours!

You should have just issued the shipping label then you would have gotten your back.
Ebay has a money back guarantee if item is snad. You have to abide by their rules to use their site.

I would expect at least to ask the buyer to send the item back to me. At least i would have prove.. Ebay should of crediited me for this loss.. not simply take my money away without telling me and have the buyer keep it.. This isn't fair..

Fair? There is nothing fair about it...
Simple, "EBay wants money, buyers have money, sellers have items, eBay doesn't want items, eBay likes buyers, eBay doesn't like sellers."

This happened to us recently, we just kept calling, and finally after a conference call with eBay and Paypal, they gave us our money back but it took quite of effort and number of calls. The sneaky part is they did it on the sly, no emails, no notifications, just silently reversed the decision, paid the buyer out, and paypal closed the case without returning our money. Only reason we noticed, is because we are small potatoes and track our balances closely. Could not imagine a bigger company having noticed this happening. Keep track of your open disputes and balances is the motto here.

You haven't been reading some of the other threads that have appeared on the boards lately, all a buyer has to do is say that they can't get the label to work or they don't feel like shipping the item back and ebay will refund them their payment and let them keep any paypal special payment money for the return ship label that ebay is now telling sellers to send to cranky buyers - so the buyer can make a profit for having their money tied up for days while the item is being shipped to them.
The solution is to check out the scam potential before listing high dollar, high risk items on ebay.

The Titanic is holding tons of water with that gaping hole in it. It sits at the bottom of the ocean- useless to anyone now except people studing it trying to figure out how it ended up that way.

You broke more then 1 rule. Phone calls ARE recorded (see Rule #4). BTW, EBay NEVER puts anything in writing.
1. EBay CS Rep's are less then knowledgeable (many would say they lie)
2. Do NOT let a case Timeout
3. Do NOT ask eBay to "Step in" (aka “help you” aka escalate)
4. ALWAYS get the reference number of the phone call, mark down the date and time
5. If the eBay CS Rep claims to have put notes in the case, have them emailed to you.
6. Never escalate a case unless you can get eBay to close it in your favor right then and there.
