So, I listed what is called an orthofix, a device for promoting spinal healing. Sort of like those muscle stimulator devices. Anyway, eBay removed the listing and warned me I will be suspended for 3 days if I try to relist it. Reason being it supposedly is an item that requires a prescription. Ok, fine. Whatever. Didn’t know. Now I do. Seems a bit excessive, but so be it. But what I don’t understand is this same item sold before and also had active listings. Why didn’t eBay remove those?

Hi, this question comes up frequently on the forum. "Why was my item taken down, and not theirs?"
The answer is "It depends." Sometimes the item is allowed for certain pre-screened sellers to market. Other times it is because information that is supposed to be in the listing is missing, according to policy. Sometimes it is because eBay failed to catch theirs and caught yours instead. Or your listing was reported and theirs wasn't. Ebay relies on the community to report policy violations. While the eBay powers-that-be are not transparent in how they police the site, it is generally accepted that a single disgruntled competitor would not be behind a takedown. It is said that multiple reports from different sources are given more weight, in particular a defrauded buyer's report counts more than say, a random member. Ebay will also remove stale listings, a newer policy change. If an item has sat without sales for months on end, eBay reserves the right to remove it.
