In most if not all states, there is no tax on second hand items. eBay is illegally taking our money. I have tried this in two different states that both have no tax on second hand items, and I was still charged.

Complain to your states sales tax board. They are charging the tax, not eBay.

@evry1nositswindy wrote:@wrong66 No it is the carbonation. I worked at a grocery store many years ago and this is how it was (and is) in Ohio. Could be different in other states, but I doubt it.
In Massachusetts, beverages are not taxed regardless of carbonation. Food is food, even if it's junk food.

Can you list a state or two that doesn't tax the sale of used items?
New Hampshire and Oregon don't have a sales tax.
I'm not sure about Oregon but NH doesn't have a state income tax though they do have to pay the IRS federally.

@navom1 : Which two states are those? Please be specific.
Sales tax is called that because it is a tax on the sale. It is not a 'new stuff only' tax.
I would also like to know, as sales tax is determined on the buyers address and you reside in one state (I assume) how would you trial it for two different states?
ETA: Is OP buyer or seller in this instance? I got confused after I posted ^^ then realised this is the Sellers board

and the earth is flat, Joe Biden is competent, and the eBay leadership understands how small sellers actually run their businesses.. these tall tales and the one about "no sales tax on second hand goods" are crowd pleasers but like most legends they ARE FALSE..SALES TAX IS A TAX ON SALES.. doesn't matter used or new.. But iam with you eBay continues the policy of full fvf on the tax its gonna be an issue forevermore.. Somebody would put up a venue that will produce like this one, id drag up TODAY...

Why don’t you be the one that creates the new venue? You could be rich beyond belief my friend.

Is education really in a decline these days? It’s a “sales” tax. Not an item tax. The government taxes the sale, not the item in question. Please use google as it is your friend.

The only place that doesn't charge any taxes on new or used items of any kind is in Utopia or in ones mind after dropping one of Timothy Leary favorite pastimes. Hints: Lake Shore Drive or Lucy in The Sky - Beatles 1967.

Actually, I asked the OP to list the states where a state sales tax is not charged on USED items as opposed to new items.

There are currently only 5 states that have no State sales tax: Alaska, Delaware, Montana, New Hampshire and Oregon. However there may be elements within the state that do have sales tax. While they may not have sales tax these states collect revenue via other taxes such as property tax or State income tax. There are hundreds if not thousands of separate State laws regarding the percentage of sales tax charged on particular merchandise such as food, clothing, etc. Whether sales tax is charged on those particular items would be part of the challenge to every seller if they were collecting, tracking and remitting sales tax on their own rather than eBay, or any other ecommerce site, doing it for them.

@navom1 : We're still waiting on your list of two states that both have no tax on second hand items. We cannot help if you cannot name which states those are.

Well then that means all of the savers, goodwill, amvets, salvation armys, tj maxx etc... are all operating illegally. That's just a small portion of brick & mortar stores around the world. Their are many many many more.

Not sure what you are referring to I have always been charged sales tax at any B&B stores including: Goodwill, Amvets, Salvation Army, TJj Maxx, etc.. Shop goodwill ecommerce site also charges sales tax for any items purchased through that venue.

Maybe the OP has been buying from Thrift Store Charities which, as charities, do not charge sales tax.
