The title of the listing says small, the item details list says size small, and there is only pics of front and back of item on a mannequin with no close ups. Buyer receives dress and the tag actually reads size 2. Would you think that would qualify for a NAD case?

Both 'small' and '2' are meaningless, since they vary from manufacturer to manufacturer.
Actually, with two *exceptions, they can vary within a brand.
The only sizing that can be trusted in actual measurements.
And even there, most Chinese manufacturers cut small, so it is worth ordering one to three sizes up.
Oddly the sizing up doesn't seem to be necessary on Indian made clothing.
*The two I am aware of are Eileen Fisher and Marks&Spencer. Marks apparently doesn't even have change rooms in their stores, because if you buy your usual size, it WILL fit.

Based on that post, I can see multiple grounds for Not As Described.
What kind of money are we talking about? Where was it shipped from (meaning where would you have to return it to)?

I agree, but if you have to file a Money Back Guarantee, be sure to select the "not as described" option, and do not mention anything about fit. Your complaint would be that it was advertised as "S" but was actually a "2".

This was a sleeveless dress listed in title and item specifics both as a small. I had no reason to ask for measurements since I'm so familiar with the brand's sizes.
What I got was a size 2. Among other things wrong with the dress ( listed NWOT, clearly worn previously), and listed as white with actual pics a little beige and stock pics of bright white. 4 pics total. Front and back, actual item and stock pics. I was expecting something in between.
Seller also sent dress with two dryer sheets wrapped up in it, and it smells so strong and terrible plus my allergies weren't that happy upon opening the package.
But I feel the wrong size listed makes a NAD claim a slam dunk. Does it fit? Yes today it does. But I can't reach too far forward or eat a large meal because it could be a questionable fit afterwards. 🙂 ha
Would you mind sharing the brand? As an XS/OO/O depending on the brand, a size 2 is an XS in some brands and a small in others. If there were no measurements it does sound like an SNAD to me.

The OP has already admitted she is very familiar with this brand and the sizes. It sounds to me like she messed up by not asking questions and making sure her mistake is OK by the boardies to file snad.

Just replying to the last post. I am the buyer. I only order one brand of clothing 99% of the time so I know this brand's sizes very well. I wear a 4-6 in bottoms and usually a medium based in broad shoulder size only if it's sized sm, med, lrg. If item is sleeveless, I can pull off a small or a 4.
This is not true. Even with the same label the fit can vary. I wear a Chico's size 3, but not all will fit. I just got a neutral for a fit issue. I could have called cs and possible had it removed, but I left it because the buyer sounds stupid. She never ask to return it.

There is very definitely size variation in a singular brand, especially Chico’s and especially in their pants. It totally depends on the cut.

So am I to take from what you suggest, that it was my mistake to not ask questions on something listed NWOT, had actual pics of item, and stock pics, listed as a size small in two places, which had it been a size small, I would have no problem keeping as it is a beautiful Michael Kors dress? If it was a size 4 even, I would keep it because it's sleeveless and I don't have to worry about my shoulder width pulling on the shoulder seam. A size 2? If I reach too far forward, I can feel the back and front of the armholes being stretched.
The dress is a hand knit (I think) laced design dress, made in India, resembling an eyelet design but the holes are larger than average eyelet hole size, a very delicate fabric.
I find it just as perplexing that you question I believed the seller, and his listing, and his description and title, so I bought the dress, yet I'm in the wrong because I didn't think ahead to ask the seller, hey is this REALLY the size you listed it as, ummm, TWICE?

Really, whether Small and Size 2 are the same thing is a moot point. What matters is that the size given in the listing didn't match the size printed on the tag, so based on that alone you have grounds for an SNAD.

You have a valid SNAD. Size 2 is XS, on the Michael Kors size chart. 4-6 is a small You aren’t to blame here and there was no reason for you to question the seller prior to purchase. I suppose you could have asked for measurements but honestly you aren’t at fault here and if you are familiar with the brand it makes sense that measurements were requested. Don’t let anyone here get to you 🙂

YES. You stated you know the brand well. So since you know the brand well than you should have known the sizes prior to purchasing. If you didn't, you should have asked when you read "small", but wondered what does small really mean. You had no problem asking here what small means. I personally would have never ordered something I wasn't sure would fit without asking.

I've always believed a size 2 would be extra small . However its always better to only buy clothing on line that give the measurements . A size small could mean differing measurements depending on the brand . Tulips
