Will somebody please help with this!

Hello

This is my first time ever having to seek help regarding E bay's policies. I've been a member since 2000 so I thought I was OK with buying and selling. I'm not a vendor,indeed I have only sold the odd item now and then,so perhaps I am a little green.

Anyway, I sold an expensive set of carbon wheels to a buyer for the sum of £1050. I then paid £30 shipping and posted them same day on a one day service(thinking I was doing well by him) I then received a notification from E bay stating that the item was not as described. I thought this strange, as he had not contacted me personally at first. He stated that there was a small scratch on one of the wheels. I was surprised at this as they were brand new and had sat in my garage for a year untouched. Anyway, I accepted the return and waited 3 weeks for the box containing the wheels to land on my doorstep.I thought it strange that it took 3 weeks to return, and all the time it was suggested by Ebay that I could issue a refund before receiving the package. I did consider this when it was announced that the package had shipped.I'm so glad I didn't. When I opened the box inside were two extremely old and battered wheels.Not only were they not my wheels they were even the same make as each other!

I took a photo of this and submitted this to him and,surprise surprise .he stated that he had never seen these wheels before in his life and perhaps the box had been tampered with on the way. I reported the incident to E bay and waited. 5 days passed I received an e-mail from E bat stating that they had closed the case and decided in favour of the buyer!Not only could I not believe this,but the fact I was not even consulted regarding the decision process beggers belief. I have subsequently contacted Ebay regarding what I need to do(which took forever)but all they have suggested is I can block the buyer and take this to the small claims court as they cannot reverse their decision. As it's stands ,after paypal ,and E bay fees,this will end up costing me nearly £2500!

I will NEVER sell on Ebay again no matter how this ends up

Can someone out there advise me on what my best course of action is? I'm going to take cousel on sueing E bay for their handling of this matter as I see them more at fault than the **bleep** that scammed me

It's not ebay's fault. They don't know who is telling the truth.

It is the thief's fault. I would take them to court. At least if they get taken to court you might win.

eBay will do very little.  Best solution is to contact local law enforcement and postal service.  File a claim with the post office. File a police report and make it clear that a) the buyer stole your item or b) someone at the postal service did.  Unfortunately these are the only things you can do.

File a theft report and stateside you can also report buyers for internet crimes as well as mail-fraud. Definitely file the theft report however and contact eBay back to appeal speaking to the resolution department. The run of the mill CSR's you get on first contact are useless! If that doesn't work then I would proceed with suing the man. Don't contact the man again, he most likely will hide them if he thinks you are contacting the police. And never sell something that expensive on eBay again, there is no protection for sellers. However if it's something semi expensive I will video myself packaging the item and video myself opening any returns, but then I file mail fraud cases on people who try and rip me off. I don't tolerate a thief whatsoever no matter the amount.

So sorry but video doesn't help as they don't know what was shipped.  And videos can be doctored.

OP also ask this on the European board.  There may be something in your country's rules that might be a way for you to proceed that we are not aware of in the US.
